    3. Presentar una queja Cualquier persona puede presentar una queja por escrito. Los formularios para presentar una queja estn disponibles en cada plantel escolar. El formulario debe completarse dentro de los primeros 6 meses de cuando el supuesto incidente ocurri.

    4. Investigacin de una queja El director de la escuela llevar a cabo una conferencia de investigacin a ms tardar dentro de los primeros 15 das de haber recibido la queja. La conferencia es una oportunidad para que el demandante y el representante del distrito presenten informacin pertinente.

    5. Decisin por escrito Dentro de los primeros 20 das de haber recibido la queja, el director de la escuela preparar y enviar al demandante un informe por escrito de la investigacin y la decisin del distrito. Incluir: La decisin tomada Una explicacin de la decisin Un aviso acerca del derecho de apelar la decisin

Apelacin al Delegado del Superintendente Si un demandante no est satisfecho con la decisin del director de la escuela, puede, dentro de los siguientes cinco das, enviar una queja por escrito al Delegado del Superintendente. Dentro de los siguientes cinco das de recibir una queja, el Delegado del Superintendente hablar con el demandante acerca de la posibilidad de llevar a cabo una mediacin. Si el demandante acepta la mediacin, el Delegado del Superintendente le enviar un informe por escrito de la decisin que incluir:

    7. Apelacin al Delegado de Superintendente (contina) La determinacin y decisin de la queja, incluyendo medidas correctivas, si es que hay alguna. La explicacin de las razones por las que se tom la decisin arriba mencionada. Aviso de los derechos del demandante para apelar la decisin a la Junta de Educacin.

    8. Apelacin a la Junta de Educacin Si el proceso anterior no resuelve el problema, el demandante podr apelar el caso a la Junta Directiva dentro de los primeros cinco das despus de haber realizado la mediacin o conferencia administrativa. La Junta de educacin podr considerar el caso en su siguiente sesin regular o especial dentro del lmite mximo de los siguientes 60 das dentro del cual deber responder a la queja. La Junta de educacin le enviar al demandante la decisin dentro de los siguientes 60 das de la fecha en la cual el Distrito recibi inicialmente la queja o dentro de un perodo que se haya acordado especficamente con el demandante.

    9. Apelacin a la Secretara de Educacin de California Si el demandante no est satisfecho con la decisin del Distrito, puede apelarla por escrito a la Secretara de Educacin de California dentro de los siguientes 15 das de haber recibido la decisin del Distrito. El demandante debe repasar la informacin del caso e incluir una copia del formulario de queja que se present localmente junto con la decisin del distrito. El Superintendente de Educacin Pblica puede intervenir directamente o el demandante puede pedir que su queja sea evaluada por el Ministro de Educacin de los Estados Unidos.

    10. La Responsabilidad del Distrito Es la responsabilidad del Distrito Escolar asegurar que los alumnos, padres o tutores legales, miembros del personal y de la comunidad reciban el aviso apropiado del Proceso Uniforme de Quejas (UCP).

    14. Registering a Complaint Any person can register a complaint in writing. Complaint forms are available at each school site. The form must be completed within the first 6 months of when the incident occurred.

    15. Investigation of a Complaint The principal of the school will set up an investigative meeting not to occur any later than the first 15 days of having received the complaint. The meeting is an opportunity for the complainant and the representative of the district to present pertinent information.

    16. Decision in Writing Within the first 20 days of having received the complaint, the schools principal will prepare and send to the complainant a written report of the investigation and of the decision taken by the district. It will include: The decision taken An explanation for the decision Notification of the right to appeal the decision

    17. Appeal to the Deputy Superintendent If the complainant is not satisfied with the principals decision, he may, within 5 calendar days, send a written complaint to the Deputy Superintendent. Within 5 days of receiving the complaint, the Deputy Superintendent will discuss with the complainant the possibility of using mediation. If the complainant accepts mediation, the Deputy Superintendent will send to him a written report of the decision taken which will include :

    18. Appeal to the Superintendent (continued) The findings and disposition of the complaint, including corrective actions, if any. The rationale for the above decision. Notification of the complainants right to appeal the decision to the Board of Education.

    19. Appeal to the Board of Education If the previous process does not resolve the problem, the complainant may appeal to the Board of Education within 5 days after the mediation. The Board of Education will consider the case at its next regular meeting or at a special meeting within a 60 calendar day time limit within which the complaint must be answered. The Board of Education will send the decision to the complainant within 60 days of the districts initially receiving the complaint or within a period that has been accorded specifically to the complainant.

    20. Appeal to the Department of Education If the complainant is not satisfied with the Districts decision, he can appeal, in writing, to the California Department of Education, within 15 days of having received the district decision. The complainant must review the information about the case and include a copy of the locally filed complaint and the districts decision. El Superintendent of Public Education may intervene directly, or the complainant may ask that his complaint be reviewed by the US Minister of Education.

    21. District Responsibility It is the responsibility of the school district to ensure that students, parents or legal guardians, staff members and community members receive appropriate notification of the Uniform Complaint Process.
