Concerns • Coordination - According to Agreements between the State and Corps • “[the state] shall have the opportunity to be involved in the pre-award process for contracts, including the opportunity to review and comment on the type of contract and all plans and specifications, to inspect the construction work, and to provide other reviews and input in to the process.”  • “the [Corps] shall consider the recommendations of [the state] in all matters pertaining to the project and shall make every effort to accommodate the concerns of the State..” • “at the request of the state, the [Corps] shall advise the State within sixty (60) days of his reasons for rejecting or modifying any recommendations made by the State.”  Coastal Protection and Restoration Authority of Louisiana

  6. Concerns • 2. Consistency Determination - • The Office of Coastal Management issued a Coastal Zone Consistency to the Corps for the construction of the Sill on October 2, 2007. This determination is valid through 2018. • The action considered dredging approximately, 660,000 – 1,000,000 cubic yards of material from this reach. The Corps is now considering 1,500,000 -2,700,000 cubic yards. • Big Picture – • Corps decisions are placing a priority on Navigation over Restoration • The Sill is designed to mitigate the effects of increased saltwater intrusion upon municipal and industrial water supplies – yet it is above the Alliance Refinery. A shift a few miles downstream would protect the refinery as well. • The Master Plan has identified this reach of the river as a major borrow source for marsh creation in the Barataria Basin to be constructed over the next 30 years.
