AB 609 (Conway)1937 Act Administrative Expenditure Cap Placeholder • SACRS Sponsored Bill • Contains intent language to examine the advisability of linking administrative expenditures with system asset levels • Consultative process with ‘37 Act stakeholders to precede development of final language • Status: Passed Assembly PERS Comm May 6, 2009

AB 850 (De La Torre)Conflict of Interests; 3rd Part Liability • Adds to existing conflict of interest prohibitions for public officials the act of knowingly inducing or conspiring to create financial gain from a state or local government contract • Status: Pending hearing in Assembly Appropriations Committee

  6. AB 1034 (Huffman) Marin County Independent District • Extends Independent District status to Marin CERA • Bill Not Heard this session • Status: Assembly PERS Committee – 2-year bill

AB 1136 (Fong)Optional Settlements • Allows revocation of optional settlements to provide for a spousal benefit if the member was 1) Married for less than 1 year or unmarried at the date of retirement and; 2) Retired before optional settlements were made available in that county • Sponsored by CRCEA • Status: Passed the Assembly PERS Comm on May 6, 2009

  8. AB 1354 (Fong)Federal Tax Conformity • SACRS Sponsored Bill • Conforms the ’37 Act to federal IRS Sec. 415 limits for benefit distributions • Further federal tax conformity language to be added to this measure • Status: Passed Assembly PERS Comm on consent May 6, 2009

AB 1355 (Fong)Survivor’s Allowances • SACRS Sponsored measure • Adds reference to appropriate code sections for alternative method for calculating survivor allowances for those receiving both ’37 Act and Social Security on a non-integrated basis • Status: Passed Assembly PERS Committee on consent on May 6, 2009

  10. AB 1406 (Emmerson)Independent District Expansion • Sponsored by San Bernardino County Employees Retirement Association • Extends independent district status to whole organization • OCERS amended out at first hearing: SBCERA only • Status: Passed Assembly PERS Comm May 6, 2009

SB 11 (Negrete McLeod)San Bernardino County Health Benefits • Allows San Bernardino County Retirement System to establish a trust for the acceptance of OPEB contributions from any local agency • Re-run of AB 1586 (Negrete-McLeod) of 2008 – caught in mass vetoes during budget delay last year • Status: Passed Senate Floor 31-3 on May 6

SB 345 (Negrete McLeod) Safety Member Death Benefits • For San Bernardino only, adjusts survivor benefits if the member dies in the line of duty prior to a scheduled salary increase • Mirrors CalPERS practice • Sponsored by San Bernardino County Deputy Sheriffs Assoc • Status: Senate Floor vote pending

SB 414 (Correa) Retirement Board Alternate Members • Deletes the authority of a retirement board to prohibit participation of alternate members • Requires BOR to fill vacancies of 2nd, 3rd, 7th and 8th members • Requires BOR to appoint alternate retired member if vacancy occurs and establishes process to fill Board of Investments vacancies • Re-run of AB 2526 (Berryhill) which failed in 2008. • Bill not heard in 2009 • Sponsor: CRCEA Status: Senate PERS

SB 538 (Sen PERS Comm) Safety Officer Mandatory Retirement • Allows for a medical certification, in LA County only, to determine if a safety member returning from disability leave is subject to mandatory retirement • Sponsored by CA Professional Firefighters • Status: Passed Senate, awaiting Assembly committee assignment

AB 128 (Coto)Worker’s Compensation: Cancer Presumption • Extends from 3 months per year of service to 1 year per year of service the time after retirement that cancer can be presumed to be work-related • Sponsored by CA Assoc of Hwy Patrolmen and CA Professional Firefighters • Opposed by CSAC, LA and Orange Counties, Rural Counties • Status: Re-referred to Assembly Appropriations

AB 1227 (Feuer)Worker’s Compensation: Leaves of Absences • Extends exisitng 4850 time to safety officers within the ’37 Act, CalPERS and LA City Police and Fire • Adds school district & CA community college police and park rangers to those eligible for 4850 time. • Expressly excludes City and County of San Francisco • PORAC sponsored • Status: Pending in Assm. Appropriations Comm

  18. SB 186 (DeSaulnier) Worker’s Compensation Pre-designation of Physician • Maintains law to allow employees to pre-designate physician in the event of WC injury • Law scheduled to sunset December 31, 2009 • Repeals report due to Legislature on 12/31/08 from Division of Workers Compensation on physician pre-designation • Sponsored by Cal Fed of Labor and Firefighters • Status: Passed Senate 29-10; awaiting Assembly committee assignment
