  2. EPA compliance • The Environment Protection Agency is an agency whose mission is to protect human and environmental health. It aims to fulfill its role by through balanced and principled use of enforcement tools to ensure compliance with the standards it lays down.

EPA Compliance and regulation • The EPA has set out certain standards meant for industries as well as residential areas that are to be complied with in order to maintain environment laws and regulations. It aims to fulfill its role of protecting the environment through balanced and principled use of enforcement toolsand EPA compliance (compliance with the above mentioned standards) to ensure consistent, fair and effective actions.Such compliance however, is not free from issues, especially when it comes to acoustics.

Optimal Noise levels • The optimal noise levels that have been prescribed in pursuance with EPA compliance is 45 decibels for residential areas, hospitals, and schools and 55 decibels for outdoor areas where human activity takes place. These levels have been prescribed so as to prevent activity interference and annoyance and are considered optimal for spoken conversation and other activities such as sleeping, working, and other recreational activities that form a part of one’s day.

Certification options for manufacturers • If you are a manufacturer, then you must ensure that your product meets the accreditation and certification requirements that have been laid down in the outdoor equipment directive issued by the EPA. This is a noise emission regulation provides three options to manufacturers who seek to be EPA compliant and want to document noise emission from their products. • Firstly, it provides for the manufacturer to take upon himself the full responsibility for initial certification, documentation, and ongoing monitoring of production units. • Secondly, it provides for the submission of an application to a notified body whereby it is contracted to examine the equipment and carry out the certification and documentation process. • Thirdly, in cases where a certified quality assurance system is already in place, only periodic audits by a notified body are required.

EPA’s regulatory regime • The Environment Pollution Agency is equipped with power to deal with negligent or criminal acts that threaten or damage the environment or which undermine its regulatory regime. Environmental legislation provides the EPA with a variety of regulatory tools and the ability to exercise discretion to determine which tool is appropriate for particular circumstances. In determining an appropriate course of action, the EPA will consider a variety of factors including, but not limited to the seriousness of the contravention, for example, the nature and extent of the impact, harm or potential harm to the environment or the potential to undermine the regulatory regime; extent and speed of remediation action required and the compliance history of the violator.
