  1. EC Violations by Industries and How to Avoid them? Environmental clearance (EC) is a crucial requirement for any project in India that may have an impact on the environment. It is a process of obtaining permission from the regulatory authorities to start a new project or expand an existing one.

  2. The EC process is designed to ensure that projects are planned and implemented in an environmentally sustainable manner, with minimal impact on the environment. However, violations of EC conditions can occur, and when they do, it is important to address them and deal with it on top-most priority. What is considered an EC Violation? The following are considered as EC Violation: 1. Starting the construction of the plant without obtaining prior Environmental Clearance (EC) 2. Operating the plant with a production capacity greater than the limit mentioned in the EC 3. Starting the construction of the plant after the validity of EC has expired.

  3. Recently, the Standard Operating Procedure (SOP) to address environmental violations was released by the Ministry of Environment, Forests, and Climate Change (MoEFCC). Projects that violate norms, but are “permissible”, will be assessed for the damage caused and a remediation plan developed. But projects which are in complete violation of environmental norms and were never eligible for grant of environmental clearance shall be demolished or closed. Steps to apply for EC under Violation Category: ● Prepare Ecological Remediation Plan, Community Welfare Augmentation plan, Natural Resource Augmentation plan ● Submit bank guarantee for the amount equivalent to ecological, community and natural resource augmentation, to CPCB for the budget to be approved by the Expert Appraisal Committee (EAC). ● Determine and pay penalty to SPCB ● In cases where operations have commenced without the required environmental clearance, 1% of the total project cost and in addition 0.25 % of the total turnover during the period of violation will be levied. ● In violation cases, where operations have not commenced, 1% of the total project cost incurred up to the date of filing of the application (for instance a fine of 1 lakh for a project worth 1 crore) will be levied. ● Complete the whole EC process, including public hearing to obtain the EC.
