As per GO issued by MoEF&CC on 2 March, 2022, industries (listed against sector 2,3,4,5 u2013 Coal washeries, Mineral Beneficiation, Metallurgical Industries, Cement plants, Distilleries, Sugar plants etc. as per Schedule of EIA Notification, 2006) have the opportunity to increase the existing production capacity as per the EC granted by up to 50% without having to go through the entire EIA process again. <br>Note: This Provision is only for the project/Activity granted EC as per EIA- 1994/2006.<br>

Enhance Existing Production Capacity without the complete EC process with No Increase in Pollution Load Certificate As per GO issued by MoEF&CC on 2 March, 2022, industries (listed against sector 2,3,4,5 – Coal washeries, Mineral Beneficiation, Metallurgical Industries, Cement plants, Distilleries, Sugar plants etc. as per Schedule of EIA Notification, 2006) have the opportunity to increase the existing production capacity as per the EC granted by up to 50% without having to go through the entire EIA process again. Note: This Provision is only for the project/Activity granted EC as per EIA- 1994/2006.

No Increase in Pollution Load (NIPL) Provision: Conditions The conditions that need to be met when applying for expansion under the No Increase in Pollution Load provision are – The pollution load should not be increased No new equipment/ machinery to be added as compared to EC granted. Installation and implementation of Online Continuous Monitoring System (OCMS) with at least 95% uptime, connected to the servers of the Central Pollution Control Board and State Pollution Control Board to report the quantity and quality of emission and discharges is mandatory. ● ● ● This can be achieved with or without any change in (i) raw material-mix or (ii) product-mix or (iii) quantities within products or (iv) number of products including new products falling in the same category or (v) configuration of the plant or process or operations in existing area or in areas contiguous to the existing area. How does it benefit you? Before these exemptions, whether or not expansions of any magnitude required to go through the entire EC process again. Now, this won’t be necessary for the sectors listed in the notification and for expansion up to 50% of existing capacity as per EC (% allowed may vary depending on the project).   3. with the CFE application and then finally attend the presentation with government authorities and the amended CFE(Consent For Establishment) with enhanced capacity is obtained. Application Process: You can apply under NIPL provision by registering through PARIVESH, an online portal. If you are an already registered user, you can log in with your username and password. If are not a registered user, you can register by selecting the project proponent/user agency. You have to continue filling in the details and documents as required. Once your user login is complete, you have to select ‘intimation concerning NIPL’. Additionally, select the appropriate responses to the questions posed and upload any necessary supporting documentation. Once all the details are filled and appropriate documents are attached, you need to accept the undertaking and then click to view the acknowledgment. It is advised that you carefully read your acknowledgment before clicking the download button.
