  2. What is FSSAI License? • The Food Safety and Standards Authority Act is an act used to protect and monitor the laws relating to food and edibles in India. The act helps establish science-based standards for food and related products to control their manufacture, storage, sale, distribution, and import. Food Safety and Standards Authority of India (central) and State Food Authorities are jointly responsible for the implementation and enforcement of FSSAI, and all the food businesses are required to follow the FSSAI rules and guidelines. FSSAI is entirely responsible for setting the standard and establishing principles for the welfare of food businesses in India. • The two kinds of licenses under FSSAI are the Central FSSAI license and State FSSAI license. The major difference between them is the size of the business. Large businesses require a central license, whereas small to medium businesses require a state FSSAI license. In addition to the FSSAI License, there is also an FSSAI registration, which is applicable for petty food retailers. • It is mandatory to get an FSSAI License or FSSAI Registration before starting any food business.

Who requires an FSSAI License • Dairy units which include milk chilling units equipped to handle and process. • Vegetable oil processing units and units that produce vegetable oil by the process of solvent extraction and refineries that include oil expeller units. • Slaughtering units. • 100% export oriented units • Meat processing units. • Food processing units that include relabelled and repackers. • Proprietary foods. • Restaurants • Hotels

Food License Registration Fee Central • New License: INR 7,500/year • Renewal License: INR 7,500/year • Modification License: INR 7,500/Modification • Duplicate License: 10% of the applicable license fee • Note: License can be renewed or issued for a maximum of 5years. State License • For any Manufacturer or Miller, the Fees are as follows: • Above 1MT/day production or 501MT to 2,500MT of milk solids per annum- INR 5,000 • Below 1 MT/day production or 2.5MT to 500MT of milk solids per annum- INR 3,000 • Hotels up to 4-star rating- INR 5,000 • All other small food business and petty shops - INR 2,000 • For all duplicate licenses, 10 % of renewal fees will be charged

FSSAI Registration Process • FLRS (Food Licensing and Registration system) launched by FSSAI is an online system to facilitate food business operators in India to apply for a License/ Registration certificate. The application can be tracked with their applications during the course of processing. 35 States/UTs have been issuing License/ Registration certificates online. • Registration is meant for petty food manufacturers that include petty retailer, hawker, itinerant vendor, or a temporary stallholder or small or cottage scale industry having annual turnover up to 12 lacs. All food businesses having income more than this limit are required to take a license.

FSSAI Registration Guidelines • FSSAI registration is initiated by submitting Form A (application) to the Food and Safety Department. • This application can be accepted, or the department may reject it within seven days from the date of receipt of an application and the rejection has to be intimated to the applicant in writing • If the application is accepted, then the department will grant a registration certificate with the registration number and the photo of the applicant. • FBO should prominently display the certificate of registration at the place of business during the business hours.

Documents required for Central FSSAI • Form B duly completed and signed • Plan of the processing unit showing the dimensions and operation-wise area allocation • List of Directors/ Partners/ Proprietor with address, contact details, and photo ID • Name and list of equipment and machinery used with the number and installed capacity • List of food category to be manufactured • Authority letter from manufacturer nominated a responsible person name and address • The analysis report of water to be used in the process to confirm the portability • Source of raw material for milk, meat, etc • Recall plan wherever applicable • Ministry of Commerce Certificate for 100% EOU • NOC/PA document issued by FSSAI etc.,

Documents required for State FSSAI • Form B duly completed and signed • Plan of the processing unit showing the dimensions and operation-wise area allocation • List of Directors/ Partners/ Proprietor with address, contact details, and photo ID • Name and list of equipment and machinery used with the number and installed capacity • List of food category to be manufactured • Authority letter from manufacturer nominated a responsible person name and address • The analysis report of water to be used in the process to confirm the portability • Proof of possession of premises • Partnership deed/ affidavit of proprietorship • NOC and copy of License from the manufacturer • Copy of certificate obtained under the Coop Act 1861/Multi state Coop Act 2002 • Food safety management system plan or certificate

Online Application Process to obtain an FSSAI License To apply for the FSSAI License online, applicants must follow the below-mentioned steps: • Go to FSSAI's official website http://foodlicensing.fssai.gov.in and check your eligibility for the registration or state/central license. • Fill out the sign-up form for the given criteria and have your account activated. • Now, go ahead and log-in to your newly created account and start filling out the application form. Make sure that you have all the documents that are required for the criteria you selected. • Once you have filled out the form, click submit and take a print out and keep it as a copy. A reference number would then be shared with you to help you keep track of the status of your application. • After receiving the application, the concerned authorities would review it and will then carry out further inspections. If the appointed inspector is satisfied with the details and the physical inspection, he or she would then forward the report, and the License would then get issued by the concerned authority. This may take a period of 60 days or more.
