Federal Advisory Committee Act (FACA) Advisory committees play important role in shaping federal government programs and policies Federal officials and nation have access to information and advice on broad range of issues In turn, public is afforded opportunity actively to participate in the federal decision-making process 8

Federal Advisory Committee Act (FACA)(cont) ITSPAC established pursuant to the Federal Advisory Committee Act (FACA), October 6, 1972; and the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), August 10, 2005 The FACA recognizes merits of seeking advice and assistance of nation’s citizens and seeks to assure that advisory committees: Provide advice that is relevant, objective, and open to the public Act promptly to complete their work Comply with reasonable cost controls and recordkeeping requirements The General Services Administration (GSA) monitors advisory committee activities government-wide 9

Federal Advisory Committee Act (FACA)(cont) Advisory committee meetings shall be open to the public, and timely notice of the meetings shall be published in the Federal Register FACA/GSA requires that the committee sponsoring agency appoint: Committee Management Officer (CMO) to oversee administration of FACA requirements A Designated Federal Official (DFO) to: Call, attend, and adjourn committee meetings Approve agendas Maintain required records on costs and membership Ensure efficient operations Maintain records for availability to the public Provide copies of committee reports to CMO for forwarding to Library of Congress 10

ITSPAC Charter • Scope and Objectives: • Function of advisory committee is advisory only • ITSPAC is expected to: • Provide input into development of ITS aspects of Surface Transportation Research and Technology Development Strategic Plan, and, specifically, into Five-Year ITS Program Plan updates (specifics in next agenda topic) • Review, at least annually, areas of ITS research being considered for U.S. DOT funding to determine: • Whether the activities are likely to advance either ITS state-of-the-practice or state-of-the-art • Whether ITS technologies are likely to be deployed, and if not, to determine the barriers to deployment • The appropriate roles for government and the private sector in investing in the research and technologies being considered 12

ITSPAC Charter (cont) • U.S. DOT Secretary Report to Congress on ITSPAC recommendations: • To be transmitted to Congress not later than February 1 of each year • Report will include • All ITSPAC recommendations made during preceding calendar year • Explanation of how Secretary has implemented the recommendations • For recommendations not implemented, reasons for rejection

ITSPAC Charter (continued) • Duration: Committee will remain in existence 2 years from charter effective date unless recommended for termination or renewal by the Secretary (charter due for renewal in February 2008) • To Whom Committee Reports: Committee will report to the Secretary of Transportation through the ITS Joint Program Office • Membership: • Committee will be composed of not more than 20 members appointed by the Secretary of Transportation upon recommendation by the ITS Management Council and the ITS Joint Program Office • Membership will be fairly balanced in terms of metropolitan and rural interests, and will include, to the extent possible, individuals and/organizations that represent minorities, women and disabled persons. • Committee members serve for up to 2 years, or until replacements have been appointed 14

ITSPAC Charter (continued) • Committee Officers: Chairman and Vice-Chairman will be appointed by the Secretary of Transportation with recommendations from ITS Joint Program Office • Meetings: • Held at call of or with advance approval of DFO • DFO must be present at each committee meeting • Approximately three meetings per year • Special meetings and working group meetings may be held as necessary • All meetings open to the public • A quorum (at least one-half of appointed members) must exist for any official action • Meeting agendas must be approved in advance by the DFO in consultation with the Committee Chairman 15

ITS Program Plan • SAFETEA-LU directs that the Secretary of Transportation develop a 5-year National ITS program plan that shall: • Specify goals, objectives, and milestones for research and deployment of ITS • Specify the manner in which specific programs and projects will achieve goals, objectives, and milestones in the context of: • Major metropolitan areas • Smaller metropolitan and rural areas • Commercial vehicle operations

ITS Program Plan (cont) • SAFETEA-LU directs that the Secretary of Transportation develop a 5-year National ITS program plan that shall (cont): • Identify activities that provide for dynamic development, testing, and revision of standards and protocols to promote and ensure interoperability of ITS technologies • Establish cooperative process with State and local governments for: • Determining surface transportation system performance levels • Developing plans for accelerating incorporation of ITS into surface transportation systems

ITS Program Plan (cont) • The ITS program plan shall be submitted and biennially updated as part of the transportation research and development strategic plan. 2008 update milestones: • Final draft: June 2008 • Submission to Congress: August 2008 • The Five-Year ITS Program Plan is available on line in the ITS Electronic Document Library (http://www.its.dot.gov/library.htm), document # 14289

Research and Innovative Technology Administration (RITA) • Coordinates the U.S. DOT research programs and is charged with advancing the deployment of cross-cutting technologies to improve our Nation’s transportation system. As directed by Congress in its founding legislation, RITA leads DOT in: • Coordinating, facilitating and reviewing the Department’s research and development programs and activities • Advancing innovative technologies, including intelligent transportation systems • Performing comprehensive transportation statistics research, analysis and reporting • Providing education and training in transportation and transportation-related fields
