  1. PRESENTATION TO PORTFOLIO COMMITTEE ON HUMAN SETTLEMENTS ON 26 FEBRUARY 2014 Closure of the National Housing Fund

  2. Table of Contents • Background • Way forward

  3. Background • A National Housing Fund was created in 1966 and subsidised housing projects were funded from this Fund. • Both Provinces and Municipalities applied for funding of housing projects which was granted as loans. • When the Housing Arrangements Act (Act 155 of 1993) was promulgated section 12B also provided for the establishment of National Housing Fund.

  4. Background cont. • Section 11(1) of the Housing Act of 1997 (Act No. 107, 1997) also provided for the continued existence of South African Housing Fund (SAHF). • In line with the provisions of this Act, funds allocated for housing development were transferred from the national vote to the South African National Housing Fund. • Funds which were not utilised remained in the fund and did not revert back to the fiscus.

  5. Background cont. • The introduction of the Division of Revenue Act (DoRA) meant that funds are to be transferred from the national vote to the provincial vote via the provincial treasury. • This rendered the National Housing Fund dormant. • As a result in August 2003, MinMec approved the disestablishment of the SAHF. • On 18th November 2003 the SAHF was de-listed from Schedule 3A of the PFMA

  6. Background cont. • The closure or the disestablishment of the SAHF can only be effected via the amendment of the Housing Act (Act 107 of 1997). • Subsequent to the de-listing, endeavours were made to amend the Housing Act in order to effect the disestablishment of the SAHF. • These endeavours resulted into the Housing Amendment Bill. • The Housing Amendment Bill was however withdrawn as a result of the change of mandate of the department.

  7. Way forward • The Department decided to embark on a process of developing a green paper. • According to the Dept’s MEDIUM TERM STRATEGIC FRAMEWORK 2014 – 2019, it is anticipated that the current Housing Act will be amended in 2017, and in terms of moving forward, be known as the Human Settlements Act.

  8. Appointment of Consultants • The appointment of consultants is approved by the accounting officer. • Units have to do a gap analysis before approval indicating reason for such appointments of consultants. • Appointment of consultants now gets reported on the quarterly performance report. • The office of the AG did not raise any adverse findings around the appointment of consultants in the last annual report.
