  3. GSA and the Federal Asset Management Environment • The Federal Government owns personal property assets valued over $1.3 Trillion. • Policies and Best Practices – GSA OGP. • Operations – GSA FAS.

  4. Several Types of Sales • Surplus – Governed by 40 USC 545 and FMR 102-38 • Exchange Sale – Governed by 40 USC 503 and FMR 102-39 • Forfeited – Governed by agency authorizations (e.g. agencies with seizure authority)

Acquisition In-Use Excess Donation Sales Sale Disposal at any stage: Non-federal transfers; Abandoned/Destroyed; and Lost Sold - $333M (2008 proceeds) Transferred to other agencies - $398M (2009) Reassigned within the Agency Exchange/Sale – $380M (2008) Donated - $343M (2009) Selected Disposal Methods: The “Normal” Disposal Process

  6. 40 U.S.C. Section 545 • (a) – Public Advertising • (b) – Negotiated Sale • (c) – Disposal through Contract Brokers • (d) – Negotiated Sale at Fixed Price • (e) – Explanatory Statements

  7. 40 U.S.C. Section 545 • (a) – Public Advertising • Public advertising to greatest extent practicable to ensure best price obtained. • To permit “full and free competition”. • Bids disclosed as required by announcement. • Sales agency accepts bid “most advantageous to the Federal Government”.

  8. 40 U.S.C. Section 545 • (b) – Negotiated Sale • Conducted in accordance with GSA policies in FMR 102-38. • Competition obtained as permitted by circumstance. • Nine circumstances where permitted. • However, see paragraph (e) on Explanatory Statements.

Section 545 • (d) – Negotiated Sale at Fixed Price • May “look” like a retail sale in a warehouse. • Public advertising not required. • However, sale should be advertised to the greatest extent practicable, and prices must reflect true market value. • Categories of property determined by GSA.

  10. 40 U.S.C. Section 545 • (e) – Explanatory Statements • Only applicable for Negotiated Sales (paragraph b). • Negotiated Sales exceeding certain values require Congressional notification. • For personal property, the threshold is currently $15,000.

  11. Federal Asset Saleswww.GovSales.Gov • Federal Asset Sales • Only approved Sales Centers (SC) may sell surplus and exchange/sale property. • Interagency selection process determines SCs. • SCs are approved to sell certain types of commodities using specified methods.
