  2. Election of 1800 Aaron Burr got as many votes for President as Jefferson did…resulting in a tie. Presidential candidates and Vice Presidential candidates were not listed on separate ballots.

  3. Election of 1800 Election is decided by the House of Representatives. Ten state delegations voted for Jefferson, 4 supported Burr, and 2 made no choice. 12th Amendment created to make sure this didn’t happen again – Pres. and VP. on separate ballots

  4. “Midnight Appointments” • Adams appointed several Federalists to judgeships hours before he was out of office (including William Marbury). • Jefferson took office, told James Madison to quit working on the appointments • Marbury sued Madison, argued Judiciary Act of 1789

  5. Judiciary Act of 1789 Congress passes a law designing the court system

  6. Court Decision • Judiciary Act of 1789 unconstitutional – because Congress has no power over the judicial branch, only the Constitution does. • Created judicial review – the authority of the Supreme Court to strike down unconstitutional laws.
