    4. Na deciso vergastada o juiz a quo reconheceu a desnecessria custdia do acusado, porm, no lhe concedeu a liberdade provisria, em razo do no pagamento do valor de R$ 830,00 (oitocentos e trinta) reais arbitrado a titulo de fiana.

    5. A Min. Maria Thereza de Assis Moura, relatora, reconheceu que a deciso foi draconiana, pois, sendo o ru assistido pela Defensoria Pblica, reconhecidamente pobre. Na deciso da Ministra foi determinado que o juiz a quo cumpra a ordem sob pena de ser comunicado ao Conselho Nacional de Justia (CNJ).
