  2. How MI surveys the market: • Administrative checks • By testing products • Co-operation with custom • Reaction to RAPEX and safeguard clause notifications • Complaints from consumers MI – Market Inspectorate

Administrative survey(two times per year, app. 20 inspectors) • Checking CE marking (if not CE marked => checking Declaration of Conformity) • Presence of manual in Slovenian language • Presence of warranty statement • Energy and noise level labelling (where it is applicable) • Labelling with sign for WEEE

  4. Co-operation with customs(throughout the year) • Slovenian custom inform MI every time when goods without CE mark wants to be imported into Slovenia (app. 50 cases per year) • Information from Slovenian custom about actions of other EU customs (app. 5-10 cases per year)

MI received 238 RAPEX notifications for LVD => found nothing on Slovenian market MI sent 18 RAPEX notifications to the system MI received 120 safeguard clausenotifications from Slovenian representative in EU => found 5 products MI sent 4 safeguard clausenotifications to the system RAPEX and safeguard clause notifications in 2005

Sampling and testing products:- reasons for sampling • Absence of CE mark • Product from “more risky group” (small household appliances, luminaires, cable reels, adaptors, power supplies) • Low price of the product • Unknown producer, absence of producer or brand name • Any notification (RAPEX, safeguard clause, ICSMS) • Consumer compliance

Sampling and testing products:- procedure • Monitoring of the products on the market (in the shops) and sampling • Finding the company that put the product into circulation in Slovenia • Acquisition of Declaration of Conformity • Putting the product to the test • Evaluation of test results • Taking measures (if necessary)

Sampling and testing products:- evaluation of test results • Class 0 – product is compliant • Class 1 – product is not compliant: deviations from product standard witch is not direct hazard for persons, but could be referred to the safety objects of LVD • Class 2 – product is not compliant: deviations witch can be direct safety hazard for persons • Class 3 - product is not compliant: very dangerous, deviations that mean obvious and direct safety hazard for persons

Sampling and testing products:- some data for the year 2005 - I • 7 inspectors are working in this group • 39 retailers were inspected • 122 products were taken to the tests • 78 products (64%) were not compliant (44 products (56%) were small house-hold appliances) • 6 samples were without CE mark (2 – class 2, 3 – class 1, 1 – class 0)

  10. Sampling and testing products:- some data for the year 2005 - II Actions by MI: • 33 meetings with producers were organized, • 34 decisions about arranging products, • 33 decisions of sales ban of the products and • 2 decisions of recallof the products were issued.
