  1. CASO Se decreta un embargo preventivo contra Juan Garay durante la etapa preparatoria de un juicio ejecutivo. Transcurren quince días hábiles sin que se promueva la demandada ejecutiva y Juan Garay solicita la declaración de caducidad del embargo, invocando el artículo 700 del Código Ritual. El demandante pide la aplicación del artículo 447 del CPC y solicita el rechazo del pedido, por no haber transcurrido aun el plazo de veinte días allí previsto
