  1. Temporary Residence Permit in Azerbaijan A Residence Permit in Azerbaijan is an official permit granting foreigners the right to live in the country for a specified duration. According to Migration Legislation of Azerbaijan, there are two types of residence permits: the Temporary Residence Permit (TRP) and the Permanent Residence Permit (PRP). We believe that this blog post will offer valuable insights regarding the basis, requirements and procedure to obtain and extend a residence permit in Azerbaijan. Temporary Residence Permit (TRP) in Azerbaijan Temporary Residence Permit (TRP) is a type of residence permit that grants foreigners and stateless persons the right to live temporarily in Azerbaijan. Cases for the Issuance or Extension of Temporary Residence Permits (TRP) to Foreigners and Stateless Persons in Azerbaijan Article 45 of the Migration Code of the Republic of Azerbaijan establishes the framework for the issuance and extension of Temporary Residence Permits (TRP) in Azerbaijan. Accordingly, foreigners and stateless persons can obtain or extend their temporary residence permits under the following cases: Investment in the Economy of Azerbaijan: Foreigners and stateless persons who invest at least AZN 500,000 (approximately USD 295,000) in Azerbaijan’s economy are eligible for obtaining and extending a Temporary Residence Permit (TRP). This investment can be made in several ways, such as by purchasing commercial real estate or investing in securities, among other viable options Real Estate Investment in Azerbaijan: To obtain or extend a Temporary Residence Permit (TRP), foreigners and stateless persons can invest a minimum of AZN 100,000 (approximately USD 59,000) in real estate in Azerbaijan; Bank Deposit in Azerbaijan: Foreigners and stateless persons are eligible to get or extend their Temporary Residence Permit (TRP) by depositing at least AZN 100,000 (approximately USD 59,000) into local banks in Azerbaijan under a term deposit agreement;

Investment in Securities: As of 2023, the Parliament of Azerbaijan has introduced a new Addendum to the Migration Code, allowing foreigners to obtain or extend a Temporary Residence Permit by investing in Securities. This provision requires a minimum investment of AZN 100,000 (approximately USD 59,000) in State Securities or in Securities from companies with majority state ownership (at least 51 percent); Business Activity in a Company with Foreign Investment: As per Law, foreigners or stateless persons who are either the head (managing director) or a founder of a company with foreign investment are also eligible to apply for a Temporary Residence Permit (Business TRP) in Azerbaijan. To clarify, this law applies to founders who own a minimum of 51% of the shares of the company with foreign investment. Also the paid-up Authorized Charter Capital of the company must be at least AZN 50,000 (approximately USD 30,000). Furthermore, for extending a Temporary Residence Permit (Business TRP) on the same grounds, the company must have an annual turnover of at least AZN 100,000 (approximately USD 59,000). It is important to note that these requirements are determined by the Decision of the Ministry of Economy of the Republic of Azerbaijan, dated January 17, 2024; Individual Entrepreneurship in Azerbaijan: As per the Law of Azerbaijan, Individual Entrepreneurs are also eligible to obtain and extend a Temporary Residence Permit (Business TRP) in the country. To qualify, Individual Entrepreneurs must employ a minimum of five full-time persons. Additionally, the aforementioned Decision of the Ministry of Economy outlines further requirements for the issuance or extension of Temporary Residence Permits. Therefore, foreign individuals residing in Azerbaijan for at least one year based on entrepreneurial activity must have a business turnover of at least AZN 50,000 (approximately USD 30,000) to qualify for applying for a Temporary Residence Permit; Management Activity in the Branch and Representations of a Foreign Company: Foreigners and stateless individuals who hold positions as head or deputy head in the branch or representation of a foreign company in Azerbaijan are also eligible to apply for a Temporary Residence Permit. Close Relationship with a Citizen of the Republic of Azerbaijan; Family Ties with Residing Foreigners and Stateless Persons in Azerbaijan; Paid Labor Activity in the Republic of Azerbaijan: Foreigners who have obtained a Work Permit in Azerbaijan are automatically eligible to get a Temporary Residence Permit in the country.

  3. Applicants can obtain a Temporary Residence Permit (TRP) in Azerbaijan for up to 1 year. Also, temporary residence permit holders can apply to extend their permit for up to a period not exceeding 2 years each time, if there is a relevant ground for it. However, in certain cases, applicants can even obtain a Temporary Residence Permit for a period of up to 3 years. An example of such a case: The purchase of commercial real estate in Azerbaijan worth at least AZN 500,000 (approximately USD 295,000).
