Council Directive 2008/120/EC of 18 December 2008 laying down minimum standards for the protection of pigs – implementation in Poland Letter from the Under-Secretary of State MrAndrzejButra to Director General Ms Paola TestoriCoggi of 7 May 2012, notifying the transposition of the Directive in question into the Polish law: Regulation of Minister of Agriculture and Rural Development of 15 February 2010 on minimal requirements and procedures for keeping of the species of farm animals for which the norms of protection have been settled in the European legislation. (Journal of Laws nr 56, pos. 344 of 2010 with the further changes).

State of play of the implementation of the art. 3 of Directive 2008/120/EC • For those farms established before 26 March 2004, not being modernized between 26.03.2004 and 1.05.2004 –rules had to be implemented before 1 January 2013 r. • For farms established after that date - rules to be followed according to the Regulation of 2 September 2003 (implementing Council Directive 91/630/EEC, proceeding Reg. of 15.02.2010)

State of play of the implementation of Directive 2008/120/EC – Tail-docking, tooth-clipping and tooth-grinding • According to art. 27 point 2 of the Law of 21 August 1997 on the protection of animals (Journal of Laws of 2003, nr 106, pos. 1002 with further changes) all veterinary procedures and zootechnical measures, as well as others procedures resulting from the production’s technology can be performed only by the qualified personnel. Those procedures have to be performed while implementing all the precautionary measures and in the way assuring limitation of any unnecessary sufferance and stress to animals. • All medical and surgical procedures, diagnostic and prophylaxis should be performed by veterinary surgeon or other persons, qualifiedaccording to rules settled in the Law on veterinary profession and veterinary chambers of 21 December 1990 (Journals of Laws of 2002 nr 187, pos. 1567 with further changes).

State of play of the implementation of Directive 2008/120/EC – Tail-docking, tooth-clipping and tooth-grinding • § 23 of the Regulation of 15.02.2010: Before performing procedures of tooth – clipping and grinding in piglets and boars and tail-docking it is necessary to implement all the measures that would prevent formation of any kind of injuries, in particular through changing conditions of in which they are kept. Those procedures are only performed in order to ensure security to the animals and to prevent formation of injuries caused by other pigs. Thus, procedures in question cannot be performed routinely.

State of play of the implementation of Directive 2008/120/EC – piglets castration • § 23 of the Regulation of 15.02.2010 Castration of piglets is performed routinely by the veterinary surgeons or veterinary technicians supervised by vet in piglets older than 7 days, applying the technics preventing tearing of the tissues, after long-term analgesia.

Controls of FBO • Instruction of the Chief Veterinary Officer of 23 August 2010 (Nr GIWz.400/AW-46/2010) on actions to be undertaken by district veterinary officers in order to perform control of the farms keeping farm animals in relation to the welfare of animals and on reporting on controls performed on those farms.

State of play of the implementationof Council Regulation 1099/2009 in Poland • As of 30 September 2012 district veterinary officers have performed controls of the controls of all slaughterhouses and fur animal farms to evaluate the level of implementation of new requirements based on the questionnaire prepared by EC. • Out of total number 1683 of entities controlled there were 817 red meat slaughterhouses.
