  3. This section covers: • Disability Access and Inclusions Plans • Supporting legislation • Six outcome areas • Agents and contractors • Reporting requirements • Resources

  4. Disability Access and Inclusion Plans (DAIPs) • Disability Services Act 1993 (amended 2004) • Outlines how public authorities will make their services, buildings and information accessible for people with disabilities

DAIP requirements: • take all practicable measures to ensure the DAIP is implemented by the authority, its officers, and relevant agents and contractors • to be reviewed at least every five years • undertake public consultation when preparing, reviewing or amending • lodge amended or new DAIPs • report to the Commission each year • report in its annual report.

  6. Supporting legislation • Disability Services Act 1993 (amended 2004) • WA Equal Opportunity Act 1984 (amended 1988) • Commonwealth Disability Discrimination Act (1992)

  7. Six desired outcomes That people with disability have the same opportunities to access a public authority’s: • services and events • buildings and other facilities • information • same level and quality of service • complaint mechanisms • consultations. • employment (optional)

  8. Agents and contractors When a public authority uses agents and contractors to provide a service to the public, those activities must be undertaken in an accessible manner. Contractors will undertake their service consistent with DAIP outcomes relevant to their service.

  9. Requirements Agents and contractors do not have to develop a DAIP but are to: • conduct their business in a manner consistent with the public authority’s DAIP. Public authorities are to: • promote their DAIP to contractors; and • report annually on DAIP implementation, including progress by contractors.

  10. Example of contractor activities • information for the public (newsletters, websites, advertisements) • sporting and recreation programs • events, such as information and consultation sessions, fairs and festivals.

  11. Special Condition • The State Solicitor’s Office developed a special condition of contract to be inserted into tender documents to clarify DAIP requirements.

  12. The Special Condition • Special Condition – Disability Access and Inclusion Plan • [Note: This clause should only be used if the Customer is required to have a Disability Access and Inclusion Plan under the Disability Services Act 1993.] • (j) Disability Access and Inclusion Plan • If the Contract involves the supply of Services to the public, then the successful Respondent will: • (i) to the extent practicable, implement the Customer's "Disability Access and Inclusion Plan" prepared under the Disability Services Act 1993; and • (ii) provide a report to the Customer by [ ] in each year of the Contract Term reporting on the extent to which the successful Respondent has implemented the Customer's Disability Access And Inclusion Plan.

  13. The Special Condition applies to: • new contracts or contract variations / renewals; and • services provided to the public. This does not apply to services provided directly to the public authority (eg cleaners).

  14. Reporting requirements There are two reporting requirements for public authorities undertaken each year: • DAIP Progress Reporting to the Commission • summarising DAIP outcome achievements in their annual report.

  16. Public authority's annual report The annual report should briefly outline the public authority’s current initiatives to address each of the six desired DAIP outcomes.
