  2. GHG Mandatory Reporting Rule • FY2008 Consolidated Appropriations Act (H.R. (H.R. 2764; Public Law 110–161) • Published in the Federal Register on April 10; there was a 60 day comment period which ended on June 9 • EPA wants to publish the final rule before the end of the year

Overview of the Rule • Facility level reporting • 25,000 MT CO2E/year threshold • Exceptions (i.e. ammonia manufacturers, HCFC-22 production, lime manufacture, nitric acid production) • Direct reporting to the EPA • Self-certification by facility designated representative • Periodic EPA audit • Reports would be submitted annually three months after the close of each calendar year

  4. MPCA Implications • Reporting is being designed outside of NEI • EPA will share received data w/ the sates but it’s not clear when and in what form • States may be asked to carry out some of the compliance/enforcement
