ADOPTION OF THE MLC • 2000 initiative by “social partners” • principles – clarity, flexibility, enforcement, wide ratification • problems with specific instruments e.g. welfare • 2000-2005 consolidation/development of text – structure and rights • February 2006 adoption of MLC • 2012 entry into force?

ILO HISTORICAL APPROACH TO WELFARE • 1936 welfare in ports Recommendation – emphasis on protection from abuse (tuberculosis, alcohol, narcotics, sexually transmitted diseases) • 1970 Recommendation on welfare – facilities and operations e.g. national/regional/port welfare boards, accommodation, recreation, information, security • 1987 Convention & Recommendation on welfare (Nos. 163 & 178) – states to ensure welfare services provided ashore and necessary finance arranged

  7. MLC APPROACH TO WELFARE • Purpose: to ensure that seafarers …. have access to shore-based facilities and services to secure their health and well-being • Obligations – to promote, encourage, allow access to services • Guidance – as per instruments 163 & 178
