  21. Rulemaking objectives of procedure Article 43 - the Management Board of the Agency is to establish transparent procedures • Draw on expertise available in the NAAs • Involve appropriate experts from IPs • Consult widely • Consult the Member States

  22. Rulemaking deliverables Three types of deliverable: • certification specifications to be adopted by the Agency • guidance material to be adopted by the Agency • opinions to be submitted by the Agency to the Commission

Rulemaking management • Agency establishes its rulemaking priorities • Agency reviews potential rulemaking inputs • Having regard to its resources Agency makes its rulemaking plan • Agency consults on its rulemaking priorities and work plan • Agency provides information on its on-going rulemaking projects to NAAs & IPs

  24. Rulemaking consultation with NAAs & IPs • Safety Standards Consultative Committee • Sectorial groups established below SSCC for each functional area • Membership • European and non-European IPs • EU NAAs • NAAs of associated European States • Selected Non-European NAAs

Rulemaking process 1 • Agency will establish a rulemaking team for each rulemaking task with Agency technical and rulemaking specialists • The team agrees ToRs and considers whether to establish a working group chaired by Agency team leader • The SSCC and/or the relevant Sectorial Group consulted

  26. Rulemaking process 2 • The team will be responsible for preparing a draft proposal assisted by a working group if established • The Agency will decide whether or not a proposal should proceed to consultation • Following consultation comments will be reviewed by the team

  27. Rulemaking process 3 The finalised proposal will be presented to the Agency Executive Director for adoption as: • an Agency certification specification • Agency guidance or • an opinion to be presented to the Commission

  38. Certification Procedures • In conclusion: Objective has been to seek continuity through adoption of established processes developed by NAAs and JAA, whilst taking advantage of the potential project management and technical oversight benefits enabled by an Agency structure
