TEEKAY SHIPPING Forum Objectives The Objectives of this Forum is to:- • Improve operator / employer awareness of the workplace OHS consultative process as per OHSMIA, • Encouraging consultation between operators / employers and their onboard employees, including HSRs, regarding OHS matters. • Encouraging greater onboard employee involvement in achieving improved OHS outcomes • Improving mechanisms for HSRs to share knowledge and information • Identifying key issues facing HSRs and the development of possible solutions

TEEKAY SHIPPING Objective 1--- Teekay Approach Improve operator / employer awareness of the workplace OHS consultative process as per OHSMIA • Teekay is committed to training of all our Seafarers in OHS. Our target is between 85% and 90% of all Seafarers to have completed an approved OHS course, not just the HSR course.

TEEKAY SHIPPING Objective 2--- Teekay Approach Encouraging consultation between operators / employers and their onboard employees, including HSRs, regarding OHS matters. • The HSR representative is noted in HSEQ meeting minutes every month. • HSEQ meeting agenda has section for HSR to raise specific issues • Master’s and Chief Engineers are all aware of Teekay’s ‘open door’ approach for OHS issues to be raised at any time by any crew including the HSR.

  8. TEEKAY SHIPPING Objective 3 --- Teekay Approach Encouraging greater onboard employee involvement in achieving improved OHS outcomes • Active workplace management teams • Encouragement of all crew to attend HSEQ meetings • Involvement in JHA preparation • Seafarers conferences

  9. TEEKAY SHIPPING Objective 4 --- Teekay Approach Improving mechanisms for HSRs to share knowledge and information • International and Australian newsletter encouraging safety articles • On board encouragement to be part of the safety management team

TEEKAY SHIPPING Teekay --- HSR Challenges Relevance of OHSMIAct --- Written in 1993 Since 1993 the ISM code has been introduced to worldwide shipping which requires a ship management company to have a Safety Management System (SMS) ISM Code is Chapter 9 of SOLAS and is an international requirement. All ships must comply with SOLAS The OHSMIAct is from an earlier period and has not recognised the significant changes to Shipping management of safety that has occurred since 1993. ISM code is not recognised by the Act so HSR is not necessarily part of the SMS.

TEEKAY SHIPPING Teekay --- HSR Challenges Relevance of Health and Safety Representative • ISM requires the Designated Person (DP) to be contactable by everyone on board for Safety issues to be raised. • DP to have access to the highest levels of management within a company • DP is to ensure that resources are available to obtain OHS outcomes • Accessible by every one on board not just HSR.

TEEKAY SHIPPING Teekay --- HSR Challenges Relevance of Health and Safety Representative • Teekay has a mature SMS that has many reporting, tracking, recording requirements • The HSR is part of the Teekay SMS and therefore needs to work within the requirements and process of the SMS • Industrial Relations and Personel issues wrapped in Safety

TEEKAY SHIPPING Teekay --- HSR Challenges Relevance of Health and Safety Representative External reporting in the form of Improvement Notes should only proceed within a SMS if; • Processes of raising OHS issues on board have been followed. • Processes of raising OHS issues with shore management have been followed • Reported to the Designated Person If there is still unsatisfactory response then; Raise an Improvement Notes under the OHSMIAct Other avenues ATSB – Confidential Reporting process

TEEKAY SHIPPING Teekay --- HSR Audits and Inspections The following are just some of the External and Internal Audits and Inspections carried out on Teekay ships; • ISO9001, ISO 14001 and OHSAS 18001 audits • ISM Code audits • OCIMF vetting inspections • Internal Safety Management Inspections • Ship Master inspections • Flag and Port State Inspections And OHS inspections under the OHSMIAct

  16. TEEKAY SHIPPING Teekay --- Conclusion Mature and Auditable SMS should be robust enough to address OHS issues within their own processes, without the need for external reporting. HSR can play an important part in this process and therefore they need to be part of the company’s Safety Management System. Also recognising that the ISM code requires compliance with relevant rules, regulations and guidelines of which OHSMIAct is one. OHSMIAct should recognise the importance of the ISM code and SMS in promoting OHS issues on board ships
