Articolo 308C.d. “clausola di flessibilità” Quando un'azione della Comunità risulti necessaria per raggiungere, nel funzionamento del mercato comune, uno degli scopi della Comunità, senza che il presente trattato abbia previsto i poteri d'azione a tal uopo richiesti, il Consiglio, deliberando all'unanimità su proposta della Commissione e dopo aver consultato il Parlamento europeo, prende le disposizioni del caso.
