  4. General situation in the EU • Free trade within the European Union (EFTA, EEA,...) • Trade regulations for 3rd party countries (Common trade policy within the EU)

  5. What Import regulations do exist? • Generally no import licence required in the EU, unless: • products are subject to import surveillance, quantitative restrictions or safeguard measures, e.g.: • agricultural goods (tariff quota), • tobacco, • weapons, • textiles (outward processing for textiles quota), etc.

  6. Restrictions & Prohibitions • Pirated or counterfeit oods (fines & destruction) • Restrictions on genetically modified organisms (GMOs) • Restrictions on import of live animals and animal products • Chemical products (Mercury, PCB, PCT products, CFC and HCFC)

  7. Situation for products from China • Textiles and clothing • 1.1.2005: quotas for mainland products removed • 1.6.2005: EU-China agreement = safegard quotas on 10 categories (2005-2007) • During 2008: full liberalisation

  8. Non-textile Manufacturing Products • Before 01.01.2005 quotas on non textile products: • certain footware • porcelain • ceramic • tableware • kitchenware • Complete liberalisation on 01.01.2005

Scheme of Generalised Tariff Preferences • 01. 2006 new EU wide generalised system of preferences ("GSP") valid 2006-2008 • Mainland China remains beneficiary • Products classified in 2 categories: • Sensitive products: 3,5% tariff reduction • Non-sensitive products: total tariff reduction • However certain products are excluded from the preference scheme

  11. Anti-dumping Measures • Several Anti-Dumping proceedings against mainland-origin products, e.g: • electronic compact fluorescent lamps (definitive duty at 66.1%) • certain leather footwear • PE-Bags(28,8% but app. 130 exceptions) ec.europe.eu/trade/issues/respectrules/anti_dumping/stats.htm

  12. Other Regulations • control of nickel use in objects intended to be in contact with the skin, such as watches and jewellery. • ban some phthalates in certain PVC toys and childcare articles on a permanent basis, which came into effect January 16th 2007. • prohibition of clothing, footwear and leather articles which contain azo-dyes, from which aromatic amines may be derived. • general food-saftey requirements

Directives for environmental protection • Directive on Waste Electrical and Electronic Equipment (WEEE) • Acc. to ElektroG importer has to guarantee and cover the product recycling • Directive on Restriction of Hazardous Substances (RoHS) • Certain products need to have RoHS certificate and special marking

  14. GPSG & EU-directives • for certain products declaration or certification of conformity required • has to be proved by producer or importer • these products have to be marked with CE and the adress of the importer in the eu • Custom may check the products for compliance

  15. Electronic devices (LVD) Toys Pressure containers gas appliances Products to protect humans Machines Sport boats Electronic devices in explosion endangered areas Elevators ... Products which require CE

  16. Other norms • Local standards committes, e.g.: • BS (British Standard) • DIN • ISO (international) • Legallynot binding, but buyers protection

  17. Economical consequences • Importers liability • Cheap products vs. fully certified products Which possibilities do I have to ensure product quality?

  18. 1. Check certificates thoroughly • Check authenticity through Certficate No. • Check if your sample is identical to the samples used for certification

  19. 2. Use test bureaus • Sample checking • Pre-Production inspection • During production inspection (10%) • Final random inspections • Loading inspections • On-Site checking

  20. Further possibilities • GS mark • TÜV-Cert • ETL verified These certifications mostly include a factory inspection to make sure that the producer can produce and maintain a standard which is according to the samples submitted
