  1. Fifth Amendment No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

  2. The fifth amendment limits the governments ability to harass its citizens • The fifth amendment deals with the rights of citizens accused of a crime. • If you are accused of a crime the accuser has to show good reason for the pursuit of trial. Basically they have to have evidence to prove that you committed the crime. • You can not be charged twice for the same crime. Double Jeopardy, if the prosecution looses its case agents you. They cant file again. They have one chance to prove their case. If it’s a hung jury they can re-file.

  3. You cannot be forced to testify against yourself. The state cannot make you take the stand a testify against yourself when your on trial. That is your choice only. • The police cannot seize private property without paying a price for it. The police have to have a search warrant to obtain your property, they cant just walk in your house and take what they want to.

  4. Personal Connection to the 5th Amendment • I have never had a chance to really use any of the amendments. • Not really for a purpose for more then arguing with someone, but that doesn’t count. • The fifth amendment is the first one I learned. By the time I was five I new pretty much everything about it. • And even now my love for the entire Bill of Rights hasn’t changed.

  5. I might be naive in thinking this, but I am glad we have the Bill of Rights. They help keep the police on the straight and narrow. • As long as you fallow the law your rights can’t be taken away from you. Even criminals have rights to protect them.
