Federal legislation fully enacted in 2004 Purpose is to: Prevent wildlife from becoming extinct in Canada Secure the recovery of Extirpated, Endangered and Threatened species Manage species of Special Concern to prevent them from becoming further at risk Applies to: All wildlife species at risk in Canada Their residences and critical habitats All lands and waters in Canada Elements: Scientific species assessment Legal listing Immediate protection Recovery planning Stewardship Enforcement DFO responsible for aquatic species Intended to be open and transparent with public input throughout process The Species At Risk Act

LEGAL LISTING • Endangered, Threatened, Special Concern • ASSESSMENT • Status Reports • COSEWIC Designations The SARA Process RESPONSE STATEMENT PROTECTION RECOVERY • Automatic Prohibitions • Protection for Endangered and Threatened species and their residences and critical habitat • Mandatory Recovery Planning • Development of Recovery Strategies and Action Plans • Identification of critical habitat

Assessment and Listing • COSEWIC status reports to government once annually • Response statement within 90 days • Consultation and analysis of social and economic consequences of listing over 9 to 18 months • DFO recommendation to EC and GIC (Cabinet) • GIC determines within nine months whether to: • Add species to Schedule 1; • Not add species; or • Refer back to COSEWIC

  5. Protection • Applies to species listed as Threatened or Endangered • Automatic prohibitions make it illegal to: • Kill, harm, harass, capture, or take a listed species • Possess, collect, buy, sell or trade an individual or its parts • Damage or destroy the residence or critical habitat of one or more individuals of a listed species

  6. Permits and Exemptions • Permit or agreement can be issued if: • Activity is scientific research related • Activity benefits the species • If affecting species is incidental to carrying out activity, and then only if: • Reasonable alternatives considered and adopted • Impacts minimized • Survival or recovery not jeopardized • Informed by Allowable Harm Assessment

Recovery Planning • Recovery Strategies and Action Plans must be developed for Endangered and Threatened species • Management Plans must be prepared for species of Special Concern • Recovery Strategy: • Science-based • Describes species biology, habitat, and threats • Identifies recovery goals, objectives, approaches, and feasibility • Defines critical habitat, or a schedule of studies • Provides timeline for action planning • Action Plan: • Implements Recovery Strategy • Identifies specific recovery measures and schedules • Describes monitoring activities • Provides socio-economic analysis of recovery actions • Must be reviewed and updated every five years

NHQ Approval DFO Regional Approval SARCC Review (?) • Process Identification: • Confirm process to draft Recovery Strategy • Draft Recovery Planning Approach for approval • Identify and invite participants • Identify pen holder for Recovery Strategy • Arrange first meeting (adopt Terms of Reference and establish Roles and Responsibilities) • Develop Consultation Plan in collaboration with Consultation Secretariat • Identify and confirm peer review process • Draft Final Recovery Strategy • Incorporate input from reviews and consultations Translation Minister Posts to SARA Public Registry (60 days) 30 days for Minister to incorporate comments • Review and Consultation: • Send for scientific peer review (PSARC or other process) • Send to jurisdictions, other relevant federal departments and Ottawa for early review • Conduct public, stakeholder and First Nations consultations Final posting on SARA Public Registry Draft Recovery Strategy

Approval Process • Recovery Planning Coordinator and Freshwater Recovery Coordinator • Prepares briefing note • Determines approval routing Director of Resource Management Program Delivery and Oceans, Habitat and Enhancement Management - CC’s appropriate regional and area directors • Recovery Lead • Sends final Recovery Strategy draft, with compliance checklists filled in Regional Director of Fisheries and Aquaculture Management and Regional Director of Oceans, Habitat and Enhancement SARA Special Advisor to DM (John Davis) SARCC (?) Director of Science Province (?) Deputy Minister Regional Director General NHQ SARA Secretariat (John Davis) Minister of DFO SARCC (?) Approval processes have not yet been finalized Provincial and DFO approval processes may happen concurrently and converge at Provincial DM and RDG approval stage
