  3. 527 CMR 1.03(9) • Makes it a violation to install “fake” fire protection devices. • Non-operable fire protection devices used to conceal cameras, intrusion alarms etc.

  4. 527 CMR 1.03 (6)(a) • Allows the Marshal to suspend or revoke any permit, license, certificate or approval issued by him. • Without a hearing • In cases where continued operation would constitute an immediate threat to public safety. • Written notice and right to a hearing within 30 days.

  5. 527 CMR 1.03(6)(b) • Requires that the holder of any license, certificate or approval issued by the Marshal shall… • Provide the Marshal with an accurate mailing address at the time of application. • Notify the Marshal within 14 days of a change of address.

  6. 527 CMR 1.03(6)(c) • Provides that any notice sent by the Marshal to the holder of a license, permit, certificate, or approval shall be deemed delivered and received if… • Sent by certified mail, return receipt requested. • To the address on file with the Marshal at the time of mailing.

  7. 527 CMR 13.03 • Revises the definition of “Charge Activated Devices” • Now defines a charge activated devices as devices that breaks rock or concrete as a result of either hydraulic or gas pressure.

  8. 527 CMR 13.15 • Provides that Blasting Damage Complaints be on a form approved by the Marshal • Eliminates the actual form from the code.

  9. 527 CMR 4.03(5)(a) • Amended to add another class of Underwriters Listed tank as being acceptable for use. • UL 2258

  10. 527 CMR 8.21(8) • Establish 15,000 gallons in the aggregate as the maximum amount of flammable liquid that may be stored in cargo, portable, or transfer tank without a license, provided a permit has been obtained from the fire department. • Does not apply to parcels of land permitted by the fire department prior to Sept. 1, 2008

  11. 527 CMR 8.21(9) • Establish 15,000 gallons in the aggregate as the maximum amount of Class II combustible liquid that may be stored in cargo, portable, or transfer tank without a license, provided a permit has been obtained from the fire department. • Does not apply to parcels of land permitted by the fire department prior to Sept. 1, 2008

  13. 527 CMR 14.03(1) • Mandates that permits for the storage of flammable or combustible liquids, solids or gases be renewed on an annual basis. • Fire department may condition renewal upon a satisfactory inspection. • May require documentation confirming compliance with the OSHA PSM Standard.

  14. 527 CMR 14.03(10) • Clarifies that 527 CMR 8 is the appropriate standard to regulate cargo, portable and transfer tanks.

  15. 527 CMR 9.05(H) • Revised the section on corrosion protection to continue to require corrosion protection for certain emergency generator tanks. • Provisions left out in error during redrafting of the regulation.

  16. 527 CMR 10.09(b) • Permits one of the 4 required fire drills to be a multi-hazard drill. • Multi-hazard drills are required under the provisions of Chapter 159 § 363 of the Acts of 2000.

  17. 527 CMR 14.01(4) • Revises scope of the regulation to exclude Class II and III liquids that are not heated above their flash points and: • Have no fire point when tested in accordance with ASTM D 92; or • Are in a water miscible solution or in a dispersion with water and have a non-combustible content of over 80% and do not sustain combustion.

  18. 527 CMR 32 • Entirely new regulation to further define the requirements for smoke detectors required by Massachusetts General Law, Chapter 148 § 26F. • Effective 1/1/2010 • Requires duel detector technology either as combination units, or individually. • Prohibits ionization detectors within 20’ of kitchens or baths.
