  2. Intro • Initially, the US Constitution did little to protect its citizens from actions of the states. • In the 20th century, the supreme court interpreted the constitution to protect the rights of citizens from state governments in a process referred to as incorporation.

  4. Selective Incorporation • Selective Incorporation is a legal code that protects rights and privileges of all citizens of the US from state laws. • The supreme court follows selective incorporation and upholds individual clauses in amendments

  5. Cases that Upheld Incorporation • 1st amendment • Cantwell v. Connecticut, 310 US 296 (1940) held that the state couldn't impose restrictions on religious grounds. • Privacy Rights • Mapp v. Ohio, 367 US 643 (1961) protected individuals against unreasonable search and seizure.
