  2. WHY WE HAVE ACCEPTED THIS INVITATION ? 1. Because Rights Management is crucial for EBU as for every broadcasting organization in the world • SOME FACTS: • SINCE THE TRANSITION TO DIGITAL OCCURRED BROADCASTERS ARE TRANSMITTING AN ENORMOUS QUANTITY OF PROGRAMMES. FOR INSTANCE IN ITALY RAI , EBU FOUNDING MEMBER, NOW RUNS 15 TV CHANNELS AND 10 RADIO CHANNELS H24 7/7. • EACH OF THE ITEMS CARRIED BY THESE CHANNELS, INVOLVES A CERTAIN NUMBER OF IPR RELATED OPERATIONS, SUCH AS : DETAILED LIST AND REMUNERATION OF THE AUTHORS AND OF ANCILLARY RIGHTS, NUMBER OF REMAINING PASSAGES, TERRITORIES AND LANGUAGES AUTHORIZED, ETC

SOME FACTS : FOLLOWS: • WITH THE EVOLUTION FROM LINEAR TO NON LINEAR BROADCASTING AND INTO THE ON-LINE/INTERNET WORLD, THIS COMPLEXITY INCREASED EXPONENTIALLY. • THE INFORMATION THAT BEFORE WHERE LIMITED BY NATIONAL BOUNDARIES NOW HAVE TO BE INTEGRATED WITH INFORMATION ABOUT ALL THE LICENSED TERRITORIES AND LANGUAGES, WITH INFORMATION ON THE OWNER OF THESE RIGHTS/OWNERSHIP PER EACH COUNTRY THAT COULD BE POTENTIALLY REACHED • TODAY IN RAI’S ARCHIVES THERE ARE 75 MILLIONS OF RECORDS (VIDEO, AUDIO, PAPERS, …) IN A MULTIPLICITY OF FORMATS. AND THIS NUMBER INCREASE EVERY YEAR AT A SPEEDY PACE AND THE IPR RELATED INFO CHANGE NEAR EVERY DAY

EBU and other broadcasting unions of the world in the past welcomed and supported various DRM systems • BUT: • NONE OF THE PREVIOUS SYSTEMS RESISTED TO THE REALITY CHECK • NO AGREEMENT WAS REACHED AMONG THE VARIOUS STAKEHOLDERS AT THE TABLE OF NEGOTIATIONS BECAUSE OF CONFLICTING INTERESTS: • PRODUCERS AND SOCIETY OF AUTHORS ARE READY TO LIMIT CIRCULATION AND ACCESS IN ORDER TO BETTER ENSURE REMUNERATION OF THEIR WORKS • BROADCASTERS (THAT ARE ALSO PRODUCERS OF SOME OF THEIR PROGRAMMING SCHEDULE) WANT TO MAXIMIZE THE DISTRIBUTION OF THEIR MATERIAL AND THE ACCESS OF THE VIEWERS • MANUFACTURERS BASICALLY WANT TO HAVE A MINIMUM OF LIMITATION AND RESTRICTION IN ORDER TO PRODUCE DEVICES THAT COULD BE SOLD EVERYWHERE

  5. 3. As a consequence of the many mistakes of the past EBU is not working on any particular solution on DRM 4. And the same occur in the rest of the world: None of the broadcasting unions today is recommending any DRM solution to its members. 5. EBU is monitoring constantly all work in progress around the world on DRM, especially in its main interest area , such as the news, where we follow the work done at IPTC or at the ODRL (open digital right language) NEVERTHELESS WE KNOW THAT THE NEED STILL EXIST, EVEN MORE THAN BEFORE, AND THAT A REAL SOLUTION OF THIS ISSUE WILL BE MORE THAN WELCOMED BY MANY STAKEHOLDERS EVERYWHERE

EBU and other broadcasting unions of the world are ready to cooperate with all the other stakeholders on DRM BUT AT A CERTAIN NUMBER OF CONDITIONS: THE FUTURE DRM SYSTEM HAS TO BE TRULY INTEROPERABLE AND NOT PROPRIETARY OR INDULGENT WITH APPROPRIATION BY ANY SIDE HAS TO KEEP IN ACCOUNT ALL NEEDS, INCLUDING THOSE NEGLECTED IN THE PAST (SUCH AS CITIZENS RIGHT TO ACCESS, FAIR USE, PRIVACY..) HAS TO BE EASY TO USE AT ALL LEVEL HAS TO BE CHEAP IN IMPLEMENTATION AND MAINTENANCE HAS TO BE ABLE TO DEAL NOT ANY MORE WITH MILLIONS OF DATA BUT WITH BILLIONS OF DATA, ADAPTED TO THE INTERNET WORLD MISTAKES FROM THE PAST CANNOT BE REPEATED, BECAUSE REPUTATION IS MORE CRUCIAL THAN EVER IN THE MEDIA FIELD.
