Legislative Mandate for the Delta Plan • Passage of the Delta Reform Act of 2009 set forthgroundbreaking new state policy: “Coequal goals means the two goals of providing a more reliable water supply for California and protecting, restoring and enhancing the Delta ecosystem. The coequal goals must be achieved in a manner that protects and enhances the unique cultural, recreational, natural resource and agricultural values of the Delta as an evolving place.” State Water Code §85054

Delta Stewardship Council • The Delta Reform Act created the Delta Stewardship Council (DSC) to develop a Delta Plan, guided by the coequal goals • Independent state agency with seven members statewide with diverse backgrounds • Delta Stewardship Council to adopt a Delta Plan no later than Jan. 1, 2012 3

  12. EIR Alternatives • No Action • Comment letter submitted by the Ag-Urban Water Coalition • To reduce impacts on water users located outside of the Delta that use Delta waters • To reduce impacts on the Delta ecosystems • To reduce impacts on Delta communities

What is the Bay Delta Conservation Plan • Bay Delta Conservation Plan • Managed by DWR • Being prepared through a collaboration of state, federal, and local water agencies, state and federal fish agencies, environmental organizations, and other interested parties • Is a long-term conservation strategy with actions needed for a healthy Delta • Implemented over the next 50 years • Shall be incorporated into the Delta Plan, if it meets the test of the 2009 legislation

  14. Next Steps October 2011: Review comments on Draft EIR and Fifth Draft November 2011: Review of Sixth Draft and submit to Office of Administrative Law for Review December 2011: Consideration of adoption of Seventh Draft with Final EIR January 2012: Final Plan presented to the legislature
