  3. Clean Water Legacy ActChapter 114.05 Purpose: protect, restore, and preserve the quality of Minnesota’s surface waters

  4. CWL Act Implementation Goals Submit TMDLs to EPA on Time Develop a Reasonable Time-Frame for Restoration Identify all Impaired Waters CWL Act Goals Provide Technical and Financial Assistance (BWSR, PCA, MDA) Comply with the Federal Clean Water Act De-list Waters

Priorities for Restoration of Impaired Waters • (1) coordinate with and utilize existing local authorities and infrastructure for implementation • (2)can be implemented in whole or in part by providing support for existing or ongoing restoration efforts • (3) most effectively leverage other sources of restoration funding, including federal, state, local, and private sources of funds • (4) show a high potential for early restoration and delisting based upon scientific data developed through public agency or citizen monitoring or other means • (5) show a high potential for long-term water quality and related conservation benefits Source: MN Statutes 114.20 Subd. 6.

Priorities for Funding Prevention Actions • The Clean Water Council shall apply the priorities applicable under subdivision 6, as far as practicable, when recommending priorities for funding actions to prevent waters from becoming impaired and to improve the quality of waters that are listed as impaired but do not have an approved TMDL. Source: MN Statutes 114D.20 Subd. 7.

  7. Criteria for Selection of Restoration and Protection Projects • Restoration:actions, including effectiveness monitoring, that are taken to achieve and maintain water quality standards for impaired waters in accordance with an approved TMDL. • Protection: implementation of measures to prevent waters from becoming impaired and to improve waters that are listed as impaired but have no approved TMDL addressing the impairment.

CWL and the Water Plan Context • MN Statutes 114D.20 IMPLEMENTATION; COORDINATION; GOALS; POLICIES; AND PRIORITIES • Relevant provisions of local and other water management, conservation, land use, land management and development plans and programs shall be taken into consideration in implementing the statute. • Public agencies with authority for local water management, conservation, land use, land management, and development plans shall take into consideration the manner in which their plans affect the implementation of this chapter.

  9. CWL and the Water Plan Context • MN Statutes 103B.3363 DEFINITIONS.Subd. 3. Comprehensive local water management plan. "Comprehensive local water management plan," "comprehensive water plan," "local water plan," and "local water management plan" means: • A county water plan authorized under section103B.311, • A watershed management plan required under section103B.231, • A watershed management plan required under section 103D.401or103D.405,

  10. 2007 CWL Review • Total Funding Available: ~ $ 8.0 million • 173 Applications ~ $ 44 million • 120 organizations • 34 Restoration Projects received ~ $ 4.4 million • 19 Protection Projects received ~ $ 3.6 million

FY08 Program Changes • Application Process: Revised application and more detailed guidance document • Dedicated Funding: Legislative appropriation more prescriptive on use of BWSR funds • SSTS: Grants for system upgrades and for county inventories available • Feedlot Water Quality Management Grants: Funds shifted to CWL from the General Fund (already disbursed through FWQMG applications) • Bonding: No funds available • Duration of Grants: Additional time for BWSR to implement funds (available until spent for most funds)

Clean Water Legacy 2008 Funding Eligibility • Projects are eligible for funding from the restoration category if they have an approved TMDL and an MPCA approved TMDL Implementation Plan by the end of the current application period--November 15, 2007. • Projects are eligible for funding from the protection category if they address priorities identified in a state approved local water management plan, regardless of the status of the water as impaired, unimpaired or un-assessed where there is not an approved TMDL and an MPCA approved TMDL Implementation Plan.

  16. Clean Water Legacy 2008Projects eligible for Protection Funds • Approved Plan: State approved and locally adopted. This includes, but is not limited to: 1) County Comprehensive Local Water Management Plan, 2) Watershed District Plan, or 3) Watershed Management Organization plan. • Connection of Plan to Proposal: The approved plan must be referenced in the application and must directly tie into the proposed Project.

  18. Who’s Eligible to Apply? • WD’s, Counties, SWCD’s, Cities (including Joint Powers groups). • There must be an approved and adopted local water management plan. • Others must work through an LGU (lake associations, watershed organizations, etc..

CWL Application Period • Application Deadline and Timeline for 2008 appropriation: October 1, 2007 Application period begins November 15, 2007 Application deadline at 4:30 PM January 23, 2008 Agency Funding recommendation approval (Proposed) by BWSR Board January-February 2008 Award notices sent February-March 2008 BWSR grant and MDA loan agreements sent Summer 2008 MPCA Section 319 Grant agreements sent

Clean Water Legacy 2008Types of Funds Available • Applicants must substantially follow cost share rules and protocols as presented in the Minnesota State Cost Share Manual. • Up to 10% of the cost share award may be used for technical and administrative support for the specific project activities. • Cost share funds require a 25% local or landowner match of cash or in-kind services. Clean Water Legacy 2008Types of Funds Available • Funds may be used for hiring staff or providing technical services to private landowners. • Projects that request both technical assistance funds and cost share funds cannot take any additional technical assistance and administrative support from the cost share allocation. Clean Water Legacy 2008Types of Funds Available MPCA/BWSR SSTS County Inventory Grant • Must have completed an MPCA Un-sewered Area Survey (’06) or submit survey data by November 15, 2007 • Must have a local septic system ordinance implementing Mn Rule 7080 • County must be grant recipient—can subcontract services • Maximum of $130, 000 per county • Area need not cover entire county • Each property in designated area must be assessed • Imminent health threat systems must meet 10-month fix-it deadline

Clean Water Legacy 2008Types of Funds Available • Any LGU eligible. • All Upgrade funds must be spent on citizen incentives. • Option 1-Grants to low income individuals to cover significant costs of the new system. • Applicant specifies maximum grant, homeowner contribution and income qualifications or other qualifying criteria. • Homeowners must attend SSTS ‘ownership basics’ class. MPCA/BWSR SSTS Grants for Imminent Health Threat Upgrade

Clean Water Legacy 2008Types of Funds Available • Option 2 -Incentive payment (applicant specifies up to a maximum of $500) to all who upgrade systems. • Homeowners must attend SSTS ‘ownership basics’ class. • Maximum Grant Amount of $50,000 per applicant. • Option 3-Applicant seeks funds to capitalize a local revolving loan program. • May be coordinated with AgBMP program or others. • Maximum award of $250,000 per applicant. • Options may be combined on application. Clean Water Legacy 2008Types of Funds Available • Activities that reduce NPS are eligible • Must be used for RESTORATION projects • TMDL approved (EPA) AND Implementation Plan approved (PCA) • Can be used as local share of Cost-share grants • Can be used as non-federal match for 319 funds • Will follow standard contracting and reporting requirements MDA Ag BMP Loans

  30. Clean Water Legacy 2008Augmenting CWL funds • Cost-share minimum 25% match • 319 minimum 1:1 match • Augmenting the CWL funds will be a factor in the ranking process • Differentiate between potential funds and funds “in-hand”

Scoring Criteria • The relationship of the proposed implementation activities to specific TMDL Implementation Plans or Comprehensive Local Water Management Plans. • The measurable results and estimated effect of the implementation activities • The level of funding that can be accessed from other sources to augment CWL funding. • Tracking installation and evaluating the effectiveness of the project initiatives. • The amount of conservation practices or initiatives that will be accomplished during the first construction season after CWL funds are received. • The level of project partners’ coordination and cooperation, project management, community support and general project description.

Clean Water Legacy 2008 Where to send application: • Completed CWL applications must be submitted electronically to the State by November 15, 2007 at the following e-mail address: cwl.funds@bwsr.state.mn.us. • The applications must be in the MS Word format provided. Paper applications will not be accepted.
