What is Communications Law? • Statutory – 1934 Communications Act and 1996 Telecommunications Act • Regulatory – Federal Communications Commission, National Telecommunications and Information Administration • Precedent – Red Lion, Prometheus, etc.
What is Communications Law? • The three questions of doom: • Watch TV? Broadcasters and cable operators are regulated by the FCC • Use the internet? ISP’s are regulated by the FCC • Use your cell phone? Cellular providers are regulated by the FCC
What is Communications Law? • Recent issues: • 700 MHz auction rules/DTV transition • MDU exclusive contracts • Media ownership • Net neutrality • Broadband penetration/availability
Communications Law Issues cont. • Creating a nationwide interoperable public safety broadband network • Cable must-carry requirements; must cable TV carry local broadcast channels without receiving compensation? • A la carte cable programming; should consumers be allowed to pick and choose what channels they receive? • Will an XM/Sirius merger be in the public interest? • How do obscenity regulations affect broadcast political advertisements?
