  2. Report of an injured Bull Terrier at this address following a dogfight.

  3. Injured Patterdale Terrier in locked yard. • Vet agreed dog was being caused unnecessary suffering and must be seized. • Police “unable” to assist? • Dog was removed before being seized. • Recovered 3 days later having been abandoned.

  4. Vet’s opinion Brick’s injuries were as a result of a recent confrontation with a badger.

  5. Arrest and Interview • Denied owning the dog. • Denied having access to the yard. • Denied having any knowledge of the dog or its injuries. • Inspector Gent was wrong about his identification of the dog.

  6. Charged with causing unnecessary suffering to the Patterdale Terrier. • Convicted following a trial at Liverpool City Mags. Ct. • 3 months imprisonment • Banned from keeping animals for 3 years.

  7. Background • 4 Men trespassing in pursuit of game. • Badger sett interfered with. • Badger case witness verbally abused. • Abusive graffiti aimed at witness. • 4 men arrested on suspicion of Criminal Damage. • Home addresses searched.

  9. Video footage • 12 individual clips. • Fowell’s dog featured on every clip. • 5 of clips dated Oct, Nov & Dec 2003. • 5 dated clips showed badgers being baited with dogs (including Fowell’s). • Dogs being encouraged.

  10. Undated clips showed offences.

  11. Charges • 1 x Trespass in pursuit of game (Poulton Hall, Merseyside). • 1 x Possession of Offensive Weapon (Birkenhead, Merseyside). • 4 x Wilfully injuring a badger (Caerwys). • 4 x Cruelly ill-treating a badger (Caerwys). • Dogs being encouraged.

  12. Defence attempted to have case dismissed, claiming that Wirral Magistrates did not have jurisdiction for offences that occurred in North Wales.This submission was dismissed.

  13. Result • Pleaded guilty to all offences. • 3 Months imprisonment. • Banned from keeping dogs for 2 years.
