The Medicines Patent Pool and the Civil Society Delegations: Work to date... • Fought for establishment of Medicines Patent Pool (MPP) • Ensuring MPP does not damage existing mechanisms (TRIPS flexibilities) • Ensure inclusion of all Lower and Middle-Income countries (LICs/MICs) • 5-year MOU with UNITAID agreed • Get companies in negotiations December 2011 UNITAID Board meeting: • MPP met 1st year milestones. • 4-year budget and business plan agreed for remaining period of MOU Civil Society delegations raised concerns over: • Exclusion of Middle-Income Countries • Restrictions to place of production, sourcing of API (amongst others) Civil Society Delegations to UNITAID Board

Next Steps: The Medicines Patent Pool (MPP) • Continue to use annual report against milestones to UNITAID Board to raise concerns of Civil Society • Listento broad Civil Society constituencies • Push originator companies to enter negotiations with MPP • Push companies and MPP for best possible licence agreements • Including all LICs and MICs, protect use of TRIPS flexibilities, oppose restrictions to place of production/sourcing of API • Voice concerns over new initiatives promoting bilateral licensing, without transparency e.g. HIV Medicines Alliance Civil Society Delegations to UNITAID Board
