The common legal framework / Energy Community acquis Energy Community Treaty consists of approx. 20 principle EU energy laws: Competition (some provisions of the EU Treaty) - Antitrust and state aid Third Energy Package for electricity and gas – liberalisation, regulation, customers Oil stocks directive Trans-European Energy Infrastructure Regulation Environment protection in energy sector – EIA, sulphur content in fuels, LCP, industrial emissions Renewables - Renewable Energy Directive – binding targets for RES in electricity, heating & cooling, transport Energy efficiency – Energy services, performance of buildings, labelling... Statistics – monthly and annual energy balances; electricity and gas prices Transmission network codes….

Gas distribution – legal requirements - Primary focus: Third party access to distribution system based on published tariffs DSO must provide for a non discriminatory and transparent access to infrastructure it operates; NRA adopts distribution tariff methodologies Unbundling of DSO from supply/production/trade business (exempted: DSOs serving less than 100,000 customers) Customer protection and retail market opening – essential role of DSOs DSOs tasks and responsibilities in operating, maintaining and investing in grids

  4. Why DSO Cooperation platform? Treaty signed by a state/Contracting Party Transposition and monitoring – by responsible Government / Ministry / Regulator Implementation – by energy market participants (including DSO) Transfer of knowledge and experience: Representatives of ministries, regulators – included in institutional meetings, bilateral discussions, legislation development….. Representatives of TSO – included in special meetings, WSs, Network Codes discussions…… Representatives of DSO – to be included in more structured format DSO Platform established in 2016

DSO-g Cooperation Platform: Aims and scope of work A platform for discussion of the DSO’ roles and obligations within the Third Energy Package and exchange of experiences how these obligations can best be achieved To cooperate in the areas of common interest: • Regulatory aspects (unbundling, cost reflectivity of tariffs and prices, investment incentives, treatment of losses and thefts); • Technical aspects (meters, integration of biogas, grid connections, load profiles); • Internal economics (investment planning, cost control and accounting policies on unbundling and procurement policies) To reflect business interests, the platform is to define common positions of DSOs and to formulate assessments and recommendations, whenever appropriate Cooperation with relevant EU associations (EUROGAS, Marcogaz, CEN….) • 4 meetings held by now • Topics in particular focus: • Unbundling, measurment, tariffs..... • Related Task Forces established; • Policy guidelines on distribution tariffs published (gas & electricity together)

TF on measurment The topic of measurment discused in Odessa at the 3rd meeting of ENDSO-g Coordination Platform – underlined as very important, requiring further work TF established in October 2017 Questionnaire sent out in October to BiH, RS, MK, MD, GE, UA Return only from UA and RS First results discused in December 2017 Next steps have required further examination & EU expirience
