Purpose and Objective of the RCP • The purpose of the RCP is to fulfill the requirements of the National Oil and Hazardous Substances Pollution Contingency Plan (NCP) Section 300.210(b) and the Clean Water Act (CWA) Section 311(j)(4). • The RCP is designed to coordinate timely and effective response among Local officials; private industry; FOSCs; Remedial Project Managers (RPMs); various Federal agencies; and other organizations to minimize damage resulting from releases of oil or hazardous substances, pollutants, or other contaminants. • The objective of this plan is to describe response protocols and assist in providing a coordinated response capability in the event of a release or threat of release endangering human health and welfare or the environment.

  4. Authority for the RCP • The RCP is developed pursuant to Section 300.210 of the NCP. • The RCP is applicable to response actions taken pursuant to the authorities under CERCLA, Section 311 of CWA, and OPA.

  5. Scope and Provisions for the RCP • The RCP expands upon the planning and response requirements set forth in the NCP • The RCP incorporates both coastal and inland areas. • The RCP will be developed in coordination with the NCP, existing local response plans, and Area Contingency Plans.

WHERE WE ARE • Updated latest ORCP • Disseminated the draft revised ORCP to USCG • Next step is to set up a committee of ORRT members for review • Subsequent revisions to the draft revised ORCP based upon ORRT member comments • Creation of a final revised ORCP • Distribution of the final revised ORCP.

  7. WHERE WE ARE • Need clear lines of delineation for spill responsibilities • Map delineating areas of responsibility • New Annexes/Appendices • Incorporating new MOA/MOU/IAAs • Drafting new MOA/MOU/IAAs

  8. CLEAR LINE TO DELINEATE RESPONSIBILITIES • USCG • EPA • State/Territory/Local Responsibilities MAP MARKING AREAS OF RESPONSIBILITY For Hawaii, American Samoa, Guam, and CNMI

  9. EXAMPLES OF NEW ANNEXES/APPENDICES: • State/Territory Emergency Response Plans • Endangered Species Act MOA • Oceania Emergency Disposal Sites • International Organizations (SPREP, etc.)

  10. Memoranda of Understanding /Agreement/Interagency Agreements • A number of agreements/memoranda have been created since the last version of the ORCP • This revision is an opportunity to incorporate more detail to jurisdictional responsibilities such as: Coastal or upland responses Federal and local response coordination

  11. SPECIFIC MISSING MOUs/MOAs/IAAs • USCG and EPA delineation of coastal and inland/upland areas for Hawaii, Guam, American Samoa, and CNMI • USCG MOU regarding coastal responses with Guam or CNMI • EPA MOU regarding inland/upland responses with Hawaii, Guam, American Samoa, and CNMI • Dispersant use for American Samoa, Guam, or CNMI • In situ burning for American Samoa, Guam, or CMNI
