  3. Association Agreement • The provisions of the agreement are of vital importance to business operations. • They cover:- • Energy • Environment • Transport • Financial and Social cooperation • The Agreement will also provide opportunities for financial assistance

  4. Free Trade Agreement • Next round of negotiations from 7 December • Trade facilitation and rules of origin chapters concluded • Negotiations concluded by December 2010? • Under Lisbon Treaty consent from European Parliament needed – so watch out for EU business lobbying • The FTA will enter into force when the VerkhovnaRada and the parliaments of the 27 Member States ratify it This gives Ukrainian business a breathing space to prepare for future trade liberalization and changes to Ukrainian legislation – USE IT

  5. Lisbon Treaty • Increased role of the European Parliament will mean that it has a greater influence on trade policy • Trade related decisions will be slowed down • The Parliament will give consent for trade agreements – giving rise to more active business lobbying, e.g. on FDI issues • Loss of power from Member States to Parliament

  6. Eastern Partnership • Business can play an important role in developing and contributing to policy development through Chambers of Commerce • The EU Ukraine Business Council is actively leading dialogue on economic integration and convergence through the Civil Society Forum • This initiative involves setting up a new Eastern Partnership Business Forum • Chambers of Commerce and other civil society organisations wishing to be involved may approach the EUUBC Secretariat or write to DG RELEX

  7. Conclusions • With the FTA, the EU comes close to being de facto Ukraine’s domestic market from 2011 – just in time for UEFA Euro 2012 • Ukrainian business should play a more active role in the FTA negotiations • Ukrainian business needs to be more visible and heard in Brussels • Donetsk Region needs to pay attention to the provisions of the Association Agreement and the FTA on energy, environment, trade facilitation, sustainable development, trade defense instruments, dispute settlement and technical barriers to trade
