  1. Unstated Right 9th Amendment “The enumeration in the Constitution, of certain Rights ,shall not be constructed to deny or disparage other retained by the people.”

  2. Reality • The reason that the 9th Amendment was created is to protect the rights not stated in the Bill of Rights. -example: Abortion ,The right to die, and Gay rights

  3. Cases • Roe V.S. Wade (Upheld) -Washington D.C.,Jan.22,1973 The Abortion case: Jane Roe was pregnant with her second child .On her second trimester she decided she wanted an abortion because her parents are already helping her raise her 5 yr. old daughter,

  4. Case • Bower V.S Hardwick (Not Upheld) -Georgia, August 1982 Two Adult Men committed sodomy in bathroom. Verdict: Commits a offence of Sodomy when performs or submits any sexual act involving the sex organs of one person and the anus and mouth of another. Punishment: imprisonment for not less then one nor more then 20 years
