Past NRD Case Assessments Natural Resource Damages Assessment and Restoration in Massachusetts Executive Office Of Environmental Affairs Objective: The Executive Office of Environmental Affairs (EOEA) is responsible for implementing a program to assess NRD resulting from releases of oil or hazardous materials and to require restoration of these injured resources to functional ecological systems. Through successful implementation of this program, EOEA is better enabled to protect and manage its vast array of resources. As steward of the state's natural resources, EOEA is committed to implementing a comprehensive NRD program which requires polluters restore injured resources and to compensate the public for the inability to use and enjoy those resources. Trustees and their representatives include: Massachusetts State Trustee Secretary EOEA Federal Trustees Secretary of the U.S. Department of the Interior (U.S. Fish and Wildlife Service, U.S. National Park Service, etc.) Secretary of the U.S. Department of Commerce (National Oceanic and Atmospheric Administration) Secretaries of the U.S. Departments of Defense, Energy, and Agriculture As Trustee, the Secretary has the authority under state and federal environmental statutes, including the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Oil Pollution Act of 1990 (OPA), the Federal Clean Water Act, and the Massachusetts Oil and Hazardous Materials Release Prevention and Response Act (M.G.L. c. 21E) to bring an action or claim for liability against a responsible party for natural resource damages (NRD) resulting from a release or threat of release of oil or hazardous substances.
