  1. Family/Medical Leave PolicyFMLA

  2. Definition • Provides up to 12 work weeks of unpaid, job-protected leave for certain family and medical reasons

  3. When Granted • For incapacity because of pregnancy, prenatal medical care of child birth • To care for employee’s child after birth, or placement for adoption or foster care

  4. When Granted con’d • To care for employee’s spouse, child, or parent, who has a serious health condition • For a serious health condition that makes the employee unable to perform the employee’s job

  5. Military Family Leave Entitlements • May use 12-week leave entitlement for employees with a spouse, child, or parent on active duty or call to active duty. • Includes family members of active duty service members

  6. Military Family Leave Entitlements con’d • Qualifying exigencies may include attending military events, arranging for alternative childcare, addressing certain financial and legal arrangements, counseling

  7. Caregiver Leave • Up to 26 weeks unpaid leave to an employee to care for a family member (spouse, son, daughter, parent, or next or kin) who is injured while serving on active military duty

  8. Benefits and Protection • University will maintain employee’s health coverage • Most employee restored to their original or equivalent position with equivalent pay, benefits, and other employment terms

  9. Eligibility • Regular Academic/Administrative, Managerial/Professional, and Office Service • FTE of .50 or greater • Have worked at 1250 hours during the 12 months preceding the start of requested leave

  10. Definition • Child shall mean biological, adopted or foster child, a stepchild, or legal ward whom employee has day-to-day responsibility

  11. Definition con’d • Parent shall mean biological parent or other individual who had day-to-day responsibility to care for and financially support employee when employee was a child

  12. Employee Responsibilities • Provide 30 days advance notice, when foreseeable. If not, as soon as practicable • Provide sufficient information including medical, ability to perform job functions, family member unable to perform daily activities, etc.
