2. Failure to comply with a College trespass notice Verbally threatening another Sexual Misconduct of any kind Exhibiting indecent/obscene conduct Possessing/using a weapon Talking/writing about plans of violence Physical Violence of any kind Being under the influence of alcohol/drugs Suspected of Child Abuse Domestic or Dating Violence Major Disruptive Behaviors

3. Handling Major Disruptions • Assess the incident and determine if Campus Safety intervention is needed. • After the incident, document the student's behavior, record their name and CARS ID#, interview any potential witnesses and attach any witness statements to the incident report. • Compile the information and forward to the Campus Safety Office for review and disposition.

4. Handling Major Disruptions • Judicial Resolution Process for Violent Incidents: • Student is accused of a conduct violation. Campus Safety is dispatched-For incidents involving violence, sexual assault or threat of violence, the student is issued an immediate College restriction. • The Campus Safety staff informs the Daytona Beach Police or the local Law Enforcement Agency of the incident for intervention and possible arrest. The JA Office is informed of the incident and places a trespass hold on the student records.

5. Handling Major Disruptions • Judicial Resolution Process for Violent Incidents: • If the student requests to return to the College, they must contact the Judicial Affairs Office to arrange a disciplinary hearing. The JA Office sends the student a follow-up e-mail via falconmail informing the student of the hearing process. The student may appear before the Student Disciplinary Committee for resolution. If the student disagrees with the Committee decision, they will have five business days to appeal to an Administrative Review Committee.

6. Handling Major Disruptions • Judicial Resolution Process for Non-Violent Incidents: • Student is accused of a conduct violation. Campus Safety is informed. For incidents involving disruptive behavior without violence, the student is issued a summons to contact the JA Office for an administrative meeting. The JA Office is informed of the incident and places a registration hold on the student records. Student is informed that they must contact the Judicial Affairs Office to arrange an administrative meeting.

7. Handling Major Disruptions • Judicial Resolution Process for Non-Violent Incidents: • The JA Office sends student a follow-up e-mail via falconmail informing them of the meeting process. The administrative meeting is conducted by the Judicial Affairs and Campus Safety Staff. The Judicial Affairs staff determines if a resolution may be reached or if a hearing is more appropriate depending on the circumstances of the case.

8. Handling Major Disruptions • Judicial Hearing & Meeting Location: • Unless otherwise noted, all judicial hearings and meetings are held in the College Campus Safety Office on the Daytona Beach Campus, Bailey Hall (B-540) in the Judicial Affairs Conference Room.

9. Disciplinary Sanctions • Warning-A verbal or written notice that the student’s behavior is a violation of the conduct Rule(s) and a directive not to repeat the behavior. • Reprimand- A strong letter of disapproval for a violation of the conduct Rules that reflects unfavorably on the student. A discipline record will be created in the student’s electronic file. • Intervention Referral-Students may be referred to a medical professional for an evaluation or may be required to complete an intervention program as a judicial sanction.

10. Disciplinary Sanctions • Registration Block -Student will not be permitted to register for courses for a designated length of time without approval from the Judicial Affairs Office. • Restitution-The fair amount of compensation for theft, loss or damage. • Restriction-Denial of certain College privileges or services for a specified period of time.

11. Disciplinary Sanctions • Probation– The student is prescribed certain conditions as a condition of enrollment for a designated period of time. • Suspension -Restriction from the College for a specified period of time. Conditions for readmission will be evaluated. • Police Trespass -The student is prohibited from any College function or event for a designated period of time. A judicial trespass hold (R05) will be placed on the student’s records. • Permanent Dismissal - Removal of a student and permanent exclusion from all College locations with no possibility of readmission or re-enrollment.

Public Safety Legal AuthorityBoard Policy Number 6.45 • Daytona State College is responsible for providing a safe environment in which all of its staff, faculty and students can realize their academic and career goals and participate in the teaching and learning experience. • The College reserves the unilateral and unlimited right to waive, suspend, alter or amend any and all policies, procedures, or guidelines to insure the public safety of students, employees and quest of the College. • There shall be no tolerance for violence or threat of violence that results in fear of personal safety or damage to College property.
