  8. Grant Flexibility CVSA Recommendations: Congress should consolidate and reconfigure the existing takedowns of the MCSAP, which would provide states with addition flexibility to better address individual needs. MAP21 • Study to reduce administrative burden • CDL expenses

  9. Compliance Reviews CVSA Recommendations Congress should streamline the Compliance Review process, while strengthening enforcement and penalties. MAP21 • Targets reincarnated carriers • Strengthens enforcement • Increases to penalties for non-compliance • Removes ability-to-pay provision

Safety Exemptions CVSA Recommendations Congress should eliminate existing exemptions in code, require that entities reapply, and strive for uniformity when exemptions are granted. • MAP21 • Establishes a handful of new exemptions • Covered Farm Vehicles • HOS 150 air-mile exemption • HOS Exemption during National Emergency • Exemption study

  11. Inter/Intrastate reciprocity CVSA Recommendations Congress should requires that interstate regulations also apply to INTRAstate operations. MAP21 • N/A

  12. Maintenance of Effort CVSA Recommendations MOE should be reconfigured along functional and performance-based lines. It also should be returned to a fixed MOE period rather than a rolling one. MAP21 • Set time frame – 2004/2005 • Excludes some expenditures • Hardship waivers • LEAD Agency

  13. New Entrants CVSA Recommendations Establish a fee to fund program; maintain 100% funding; expand eligible expenses to include education/training. MAP21 • Safety review deadline: • Property Carriers – 12 months • Passenger Carriers – 120 days • Proficiency exam requirement

  14. One-Stop-Shop CVSA Recommendations Establish web-based portal within FMCSA that combines the common data elements of a number of programs. MAP21 • Directs Secretary to make funds available for improved data collection • Requires more frequent update of carrier data

Drug & Alcohol Testing CVSA Recommendations Provide FMCSA authority to establish a national drug & alcohol testing clearinghouse as well as authority to close down fraudulent drug testing laboratories. Provide adequate funding. MAP21 • Directs the Secretary to establish clearinghouse • Provides for privacy safeguards / strict access controls • Permits Secretary to collect a fee to fund initiative

  16. Outreach CVSA Recommendation Congress should ensure that funding for education and outreach remains at 100% and make more funding available for state initiatives. MAP21 • Funding is increased • Funding remains 100%

Bus and Motorcoach Safety CVSA Recommendations CVSA had a number of recommendations regarding Bus & Motorcoach safety. • Require EOBRs; State Vehicle Inspections; Safety Belts; Occupant Protection Standards • Strengthen carrier requirements on new entrants MAP21 • Requires EOBRs; Safety Belts; Occupant Protection Standards • Investigate Annual Inspections • Tighter registration requirements, additional oversight of carriers & drivers

  18. Onboard Safety Systems CVSA Recommendation CVSA supports legislation that encourages accelerated adoption of advanced safety systems for commercial vehicles, specifically: electronic brake stroke monitoring systems; vehicle stability systems; lane departure warning systems; and collision warning systems.   19. Truck Size & Weight CVSA Recommendation Congress should direct DOT to investigate impacts of increased weights to safety, environment, infrastructure, etc. MAP21 • Includes Truck Size & Weight Study, specifically identifying impacts to safety as item to be researched

Miscellaneous • Jason’s Law – provides for truck parking facilities • Incentives for Graduated Drivers License Programs • Analysis of CMV crashworthiness standards • Canadian Safety Rating Reciprocity • National Registry of Certified Medical Examiners • Minimum entry-level training requirements for CDL • Wetlines Study
