  4. The Legal Environment Disparate Impact • The selection measures most likely to cause disparate impact are the numerous certification requirements. Disadvanatged Protected Groups • Males have a higher pass rate and currently hold more certifications than females. Legal Defense • Contract requirement and workforce development program to help disadvanatged workers. Hiring the Disabled • Deny employment for the Instructor position to the deaf and blind. Consider all applicants with disablities if reasonable accomodations can be made.
