Case of legislative support to protect human rights in Japan 《Psychiatric review board for persons with mental disorders》 Annex 8 ・The administrator of a mental hospital shall endeavor to hospitalize patients on a voluntary basis. ・With regard to compulsory hospitalization, two medical examinations by different designated physicians of mental health are obliged. ・With regard to hospitalization for medical care and protection, a medical examination by adesignated physician and permission of his/her families(or relatives) is required . After hospitalization… A psychiatric review board examines an involuntary patient’s hospitalization from the viewpoint of human rights. 【Mental hospital 】 In the case of involuntary hospitalization, the administrator of a mental hospital shall submit the following documents: ・Admission form (within 10 days of admission) ・Regular reports (with regard to compulsory hospitalization, 3 months after admission andevery 6 months thereafter. With regard to hospitalization for medical care and protection, every 12 months.) 【Involuntary patients, and his/her families(or relatives)】 They are entitled the following rights: ・to request discharge of patient ・to take measures necessary for improvement of his/her treatment Requesting an examination Submission of the report Examining Authority “Psychiatric Review Boards” which are set up in each prefecture as a third-party organization. Members: ・designated physicians specializing in mental health ・persons with legal knowledge and experience (for example, lawyers, public prosecutors) ・persons of learning and experience regarding health and welfare as related to mental disorders (from April 2016, it is defined as persons of learning and experience in “some area”.) If it is judged that the hospitalization was inadequate… The prefectural governor (or mayor) shall order hospital to discharge patient or take measures necessary for improvement. Furthermore, the revised“Law Related to Mental Health and Welfare of Persons with Mental Disorders” provides the following from 2016: ・improvementof the manual of the Psychiatric Review Boards ・establishment of a committee to discuss the necessity of hospitalization and efforts for discharging in cases of persons hospitalized for medical care and protection whose hospitalized period is longer than planned. *The content of Annex8 is defined under the ”Law Related to Mental Health and Welfare of the Persons with Mental Disorders” in Japan.
