  23. Court of Claims In the event that expenses were incurred prior to the current state fiscal year, funds must be disbursed by filing a claim with the Illinois Court of Claims.   27. Who is subject to Grant Funds Recovery Act? In all ICJIA contracts and subcontracts there is language stating that the agreement is subject to the Grant Funds Recovery Act.   28. Grantor Agency Authority According to the Act “the grantor agency making the grant shall take affirmative and timely action to recover all misspent or improperly held grant funds.” 6/26/2014 | Illinois Criminal Justice Information Authority | 29

Grantor Agency Authority In order to effectuate the recovery of such grant funds, the grantor agency making the grant is authorized to use any one or a combination of the following:  (a) offset against existing grants of, or future grants to be made by, the grantor agency making the recovery; (b) authorize the offset from existing grants or grants to be made by other grantor agencies; 6/26/2014 | Illinois Criminal Justice Information Authority | 30

  30. Grantor Agency Authority (cont.) (c) authorize the Comptroller to offset any payment from any funds administered by the Comptroller for payment to the grantee, including, but not limited to, distributions of appropriated funds and payment of refunds; (d) initiate any debt collection method authorized by law to any private person; or (e) remove the grantee from any of the grantor agency's programs and forbid the grantee's participation in any such future grant programs for a period not to exceed 2 years. 6/26/2014 | Illinois Criminal Justice Information Authority | 31

  32. Informal Hearing • A meeting with ICJIA with the purpose to discuss the facts and issues to resolve any conflicts prior to taking to a formal hearing. 6/26/2014 | Illinois Criminal Justice Information Authority | 33

  33. Formal Hearing • Written notice from the grantor agency to the grantee of the intended recovery. The notice will identify the amount of funds due and the facts which permit recovery. • Within 35 days of the notice the grantee may request a hearing. • The hearing is held and at the conclusion of the hearing a final written recovery order is issued by the grantor agency and sent to the grantee. • The grantee may seek judicial review pursuant to the Administrative Review Law. 6/26/2014 | Illinois Criminal Justice Information Authority | 34

  34. Recovery of Grant Funds by the Illinois Attorney General • The Attorney General, on his own volition, may act to recover any grant funds which have been misapplied or are being improperly held and, when doing so, has all the powers of collection established in this Act in addition to any other powers authorized by law or the Constitution. 6/26/2014 | Illinois Criminal Justice Information Authority | 35
