  3. WHY HAVE A DESK REFERNCE/ 1 OF BIGGEST CHANGES. - 5050.4B focuses on NEPA. - Compendium of reqs. outside NEPA - PRIMARY PURPOSE:Helps integrate those non-NEPA reqs. with NEPA. • Other agency orders focus on NEPA. - Reaction? Initially mixed, now liked.

  4. WHY HAVE THE REFERENCE? -Airports require lots of area. - Physical impacts are likely more severe than those due to other FAA actions. - Significance threshold review. - Desk Reference incorporates valuable info from 5050.4A and presents more than in 1E.

  5. WHY HAVE THE REFERNCE? Over 20 special purpose laws, regs or Executive/departmental orders…focus on airport actions. Some are… AIRFA Archeological and Hist. Preservation Act. Clean Water/ Clean Air Coastal barrier/zone ESA FWCA Executive Orders Farmland Protection Marine Mammal Pro. Magnuson-Stevens NAGPRA Section 6(f) of L&WCF Section 106 of NHPA Section 303c(4f) Section 47106c of 49 USC Wild and Scenic Rivers Uniform Relocation DOT Orders FAA Orders

WHY HAVE THE REFERNCE? - Those laws, regulations, executive orders change more often than NEPA (NEPA regs changed in 1978). - Lackof updated information in 5050.4A was a legitimate concern. - Instead of issuing Supplemental Guidance Letters, (we issued >15)… - We’ll updatethe Desk Reference. - Internet= fastest, most direct, fastest, efficient way to deliver changed requirements, models, or methods.

  7. CONTENT. - Each resource has its own chapter. -Consistent format:__________________________________ Chapter # and Resource. 1. Introduction. 2. Table of applicable laws, regs, etc. 3. Applicability to airport development projects. 4. Permits, Certifications, and Approvals. 5. Regulatory compliance procedures – environmental analysis. 6. Determining impacts. 7. Determining impact significance. 8. Environmental Impact Statement content.

ENFORCEMENT - Existing laws / regulations protect resources. - Enforcement occurs under the applicable laws, regulation(s) or executive order, not Desk Ref. - Desk reference is a compendium of existing laws regs. and focuses them on airports. For convenience and to help “streamline” your reviews.
