  10. Milestone Implementation & Tracking Chesapeake Bay Model is only reflective of what is entered. Common discussion point at workgroups: BMPs are in place that have not been reported, including agricultural and stormwater BMPs. WIP Solution: Un-reported/Under-reported BMP Initiative. External groups interested in helping.

Un-reported/Under-reported BMP Initiative (Pages 80 & 201-203 of WIP): • Discussions with Conservation Districts initiated at “All Bay” Day • NACD project to develop protocols with EPA for reporting un-reported/under-reported BMPs • Data being gathered for Street Sweeping, currently reported as zero for progress runs

  12. Un-reported/Under-reported BMP Initiative (Pages 80 & 201-203 of WIP): • Stormwater: Working to see if EPA may recognize a performance standard for new Chapter 102 permits. Could possibly reduce the need to count future BMPs. • Center for Dairy Excellence collecting data for 30 farms and working with 4-6 Conservation Districts

  13. Milestone Implementation & Tracking “Million Pound” Project Goal: Million pounds of reductions annually through grants and other funding sources. PennVEST and Green Initiatives could provide $20 million. Growing Greener Special Watershed Consideration given for Chesapeake Bay Nutrient Reductions.

  14. “Million Pound” Project (Page 197 of WIP): • Growing Greener Grant Announcement of January 6, 2011. Current application round open. • DCNR modified their Community Conservation Partnerships Program (C2P2) application this year to increase the priority and awareness of "Green/Sustainability" Projects.  C2P2 funds various projects related to recreation (parks, trails, etc). Closed April 20th.

  15. Milestone Implementation & Tracking Pennsylvania Point Source Strategy developed in December 2006 does not change. Significant Facilities: Cap Load Allocation based on Design Flow at 6 mg/l TN and 0.8 mg/l TP 3-phase 10 year strategy Cap load met in first 5 year phase. 63 plants – 85% Phase 2 (50 plants – 10%) & Phase 3 (70 plants – 5%) to maintain the cap load into the future as systems approach design capacity Non-significant: Cap Load Allocation based on Design Flow at 8 mg/l TN and 1 mg/l TP 0.2 mgd to 0.4 mgd first Significant Industrial Facility Plan completed. 30 significant industrial dischargers: Discharge more than 75 lbs/day of TN and/or 25 lbs/day of TP. All industrial dischargers with a potential to discharge nutrients (significant and non-significant) will be required to monitor for nutrients.

  16. Point Source Strategy: • Point Source Strategy continues to be implemented. As of December: Phase 1: All 63 permits issued; Phase 2: 43 of 47 issued; Phase 3: 12 of 74 issued; plus 30 industrial permits being worked on • 2010-2011 is the 1st compliance year for 28 facilities (see pages 52-53 of WIP)

  17. Milestone Implementation & Tracking Identify and implement new BMPs such as Legacy Sediment removal. Local Leadership Lancaster County Clean Water Consortium Lycoming County Chesapeake Bay Initiative Air Reductions (State) Anti-Idling Law; Glass Melting Furnaces; Cement Kilns; and Renewable Energy/Energy Efficiency (RE/EE) and Demand Reductions.

Milestone Implementation &Tracking Forestry Integrating State Forestry Assessment & Report Urban Tree Canopy Resource Extraction Draft Stormwater General Permit for mining activities Pennsylvania Phosphate Reduction Act of 2008 Mandates virtually no phosphate in dishwashing detergent, effective July 1, 2010.

WIP Implementation: Urban Tree Canopy (Page 198 of WIP): • DCNR Chesapeake Bay Forester meeting with municipalities to provide technical assistance regarding benefits of tree canopy Air Quality (Page 200 of WIP): • Requested EPA quantification of two air quality rules for nitrogen deposition reductions • Proposed rulemaking: High Electric Demand Days

  22. Legislative Efforts (Page 213 of WIP): • Chesapeake Bay Commission Leadership: • Urban Nutrient Management • At May meeting, communications with Congress/Executive Agencies about importance of sustained funding

Advanced Technologies and Nutrient Trading: • Six (6) Point sources and Eighty (80) Nonpoint source projectshave certifications for credits • Recent PennVEST auctions • 10 contracts • Commonwealth Financing Authority will be submitting an application to USDA to be considered an approved entity or “bank”. If the application were approved then CFA could be the lender of $$ for projects and USDA would provide CFA the loan guarantee.

Water Quality Initiative (Pages 97 & 196 of WIP): • Four positions funded by EPA’s Chesapeake Bay Regulatory and Accountability Program (CBRAP) ---page 100 of WIP • Starting this month (July 2011), Ches Bay Technicians, located in the Conservation Districts, to do 100 site visits/year which will be education and outreach related to compliance with existing Pennsylvania regulations.

  27. Water Quality Initiative (Pages 97 & 196 of WIP): • Manure Management Manual Being Updated • June 16th, draft presented to Agricultural Advisory Board • Contains various guidance, such as what should be included in a Manure Management Plan • Additional information on page 66 of WIP
