  2. Introduction E-Form ACTIVE (INC 22A) EForm ACTIVE (INC 22A) is the latest compliance introduced by the Ministry of Corporate Affairs in its latest ordinance of 2019. ACTIVE stands for Active Company Tagging Identities and Verification.

  3. Reason Behind Form ACTIVE (INC 22A) Following are the reason behind filing eForm ACTIVE (INC 22A) • Showing that the company is active • Showing that the company is actually functioning • Showing that the company isn’t fictitious • Showing that the company isn’t just a shell company.

  4. Companies That Have To File the Compliance • Companies that have been registered on or before 31st December 2017 have to file the compliance. • These are the companies that are not counted among dispute companies.

  5. Companies That are Exempted From Filing the Compliance • Companies that have been struck off. • Companies that are under the striking off process. • Companies undergoing amalgamation. • Companies that are about to be liquidated. • Companies that are liquidated.

  6. Final Date of Filing e-Form ACTIVE (INC 22A) The final date of filing eForm ACTIVE INC-22A is 25th April 2019.

  7. Documents Required To File E-Form ACTIVE INC 22A Following are the documents that you require to file eForm ACTIVE (INC 22A): • Photographs of the company headquarters. • Email ID and OTP. • List of directors of the company. • Key Management personnel details. • Director Details. • Company Secretary Details.

  8. Photographs Need To Be Attached In Form INC-22A • Photograph of the company building from the outside. • Photograph of the company’s infrastructure from the inside. • Photograph of the company’s infrastructure with the director of the company present.

  9. Active Non-Compliant Companies: Additional Penalties Forms That Can’t Be Filed If the Company Is Marked Active-Non-Compliant: • SH-7: Form to inform change in share capital. • PAS-3: Form to return the allotment. • DIR-12: Form to declare change in company personnel. • INC-22: Form to change the address. • INC-28: Form to file a notice to court.
