  1. IMPLEMENTATION OF REGULATIONS: FIREARMS CONTROL ACT 2000 BRIEFING TO PORTFOLIO COMMITTEE FOR SAFETY AND SECURITY 2003-06-11

STATUS OF AMENDMENT BILL • Previous briefing: promotion of draft Bill in tandem with implementation of Regulations. • Phased implementation of Bill and Regulations required. • Draft Bill finalized and certified by State Law Advisers. • Draft Bill formally introduced in Parliament on 3 June 2003.

  3. CONTENTS OF AMENDMENT BILL • Purpose of Bill to correct drafting, grammatical, and other errors in order to enable effective implementation. • Only new matters addressed in Bill: • Substitution of game hunter by game rancher . • That forms shall not form part of Regulations. • Provision for apprentice to gunsmith to be in possession of Firearm. • Provision for regulations in respect of Firearm Fee Zones.

  4. Further proposals: draft Bill • State Law Advisers recommended insertion of definition of “game rancher”. • To delete the provision re commencement of Act, in order that it will commence immediately after promulgation: effect. • For consideration: Comments regarding sports shooting; could be dealt with in public hearing.

  5. PHASED IMPLEMENTATION • Necessity to finalize accreditation before licensing can commence. • Comprehensive Draft set of Regulations were published for comments. • Only Regulations pertaining to accreditation were finalized and presented to State Law Advisers. • Advised that Amendment Bill must be adopted by Parliament before promulgation of Regulations and commencement of sections related to accreditation. • Balance of Regulations to be finalized during accreditation process.

  6. ACCREDITATION REGULATIONS • Copy presented to Committee. • Provides for accreditation of: • Public collector, hunting association or sports-shooting organisation, collector’s association, museum, shooting range, training in use of firearms, to provide firearms for use in theatrical, film or television productions, game rancher, business in hunting, other business purposes and official institutions. • Appeals procedure.

  7. WAY FORWARD • Adoption of Bill as soon as possible. • Commencement of the sections of the Act relevant to accreditation. • Simultaneous promulgation of Regulations pertaining to accreditation. • Finalisation of initial accreditation process. • Finalisation of balance of Regulations during accreditation process. • Commencement of remaining sections of Act and simultaneous promulgation of remaining Regulations.
