  6. 2. Project synopsis 2/8 Overall objective: • To contribute to a high level of protection of consumers in Serbia. Purpose: • The market surveillance system in Serbia is able to effectively and efficiently perform its tasks and responsibilities under the new legislation for product safety and food safety, and to protect against products that pose serious threats to health, safety, and the environment.

Project synopsis 3/8 Result Area 1: • Enhancing the technical capacity of MTT-MI and the other beneficiaries, to include new rules and regulations aligned with the acquis communautaire as well as support for implementation and enforcement of relevant technical legislation in agreement with the legal framework for product safety in Serbia.

Project synopsis 4/8 Result Area 2: • Facilitating and managing change in strategy development of MS authorities and improving cooperation as well as coordination. • Support to development and implementation of strategic and operational plans, a Management Information System and support to the operation of the Product Safety Council.

Project synopsis 5/8 Result Area 3: • Facilitating and managing change in the operational field by enhancing the market inspectors’ understanding of legal and theoretical aspects of the new regulations. • Enhancing MS Inspectors competence (practical, general, legal, technical, inspection and other skills) to enforce consumer protection.

Project synopsis 6/8 Project consortium • This project is funded by EU and implemented by GFA Consulting Group GmbH, in consortium with SIQ – Slovenian Institute of Quality and Metrology, SFVS - State Food and Veterinary Service of the Republic of Lithuania, TSI - The Trading Standards Institute and TÜV Rheinland Consulting GmbH.

  13. 3. Features of the project 1/3 Support of the Serbian MS strategy and the law on Market Surveillance by an evidence based approach using the „MS efficiency Model“

Features of the project 2/3 Importance of a market surveillance model • It shows the interaction between: • Technical legislation (essential requirements), conformity assessment (measurement uncertainty), (product)standards, risk assessment • Inspection services are part of conformity assessment

  16. 4. Coordination with donors 1/4 • Meetings with other donors as follows: • USAid – Business enabling project (E-inspection software) but in Chemicals field • GIZ – Quality Infrastructure project • Consumer Protection project

Coordination with donors 2/4 4.1 Definition of Market Surveillance (765, art. 2, p.35) • “Shall mean the activities carried out and measures taken by public authorities to ensure that products comply with the requirements set out in the relevant Community harmonisation legislation and do not endanger health, safety or any other aspect of public interest protection.”

Coordination with donors 2/4 4.2 General Product Safety Directive • Applies to both harmonized and non-harmonized area • In the harmonized area, this refers to technical legislation of New Approach, Old Approach together with NLF (764, 765, 768) and GPSD • GPSD could be seen in the harmonized area as a “safety net”

  19. 4. Coordination with donors 4/4 4.3 Market Surveillance performance (765, art. 19) • Sampling shall be adequate • This is a higher level requirement but no quantitative information is given

Preliminary conclusions 1/1 • We have coordination with at least 3 donors in the main field of the Project • In particular we are considering the use of data of the Consumer Complaints database in the MIS • Coordination with the Consumer Protection Project could be enhanced in: • The GPSD area • The performance setting of Market Surveillance actions
