  2. The Clean Air Act Needs a Major Re-Write • Either act on global climate change with detailed laws or tell EPA not to • Fix CAIR and CAMR nullifications • Longer planning and corrective action timelines for non-attainment • Change NAAQS-setting process adem.alabama.gov

  3. Ozone in Alabama • Out of 23 monitors, 14 are at 75 ppb or higher based on 2006-2008 data • At least 3 more are likely to be out by end of 2008 ozone season • Lowest monitor reads 65 ppb, all others 70 ppb or higher

  4. Fine Particles-Annual Standard • Out of 26 monitors, 6 are over 15 ug/m3 based on 2005-2007 data • 5 in Jefferson County • 1 in Russell County (Phenix City/Columbus, GA) • Lowest reads 11 (Mobile area) • Lowest inland monitor reads 13 (NW corner of Alabama) • Plan was for CAIR and other national controls to fix problems, with some local reductions in North Birmingham

  5. Fine Particles-Daily Standard • Out of 26 monitors, 3 are over 35 ug/m3, based on 2005-2007 data -All 3 Jefferson County -Negotiating with EPA over data problems at a monitor in Gadsden -Continuing discussions with EPA over extent of non-attainment areas

  6. Regional Haze Plan • Submitted to EPA in July • Relies heavily on CAIR • Approvability Is a national issue

  7. Construction Permitting • No major issues • Trying to set policy for complex PSD permit rule changes • Quarries continue to be controversial

  8. Operating Permits • No major issues • CAM (increased monitoring and reporting requirements) in Title V permits • Emission fee about $34/ton • Expected to be stable or even drops slightly in near future

  9. Rulemaking • Deleted Boiler MACT due to court action • Opacity exemption up for vote in late August • Deletion of CAMR up for vote in late August • Delete CAIR and bring back NOX SIP Call Rules???

  10. Enforcement • Number of penalties up for FY 08 • Average $ per penalty down • Most common violations: - Failure to submit compliance reports - Failure to perform monitoring - Stack test failure - Gasoline marketing chain
